WICHITA, Kan. — The Sedgwick County District Attorney’s Office announced Friday that the Kansas Supreme Court has upheld the convictions of Tyler Eugene Kelly for felony murder, aggravated burglary, and aggravated assault.
Kelly appealed his conviction on several grounds, claiming there was not enough evidence to prove he entered the victim’s home illegally or intended to commit a crime, and multiple allegations of prosecutorial error. He also argued that the trial court should have given a “use-of-force” instruction to the jury, which might have supported a self-defense claim.
In a unanimous opinion written by Justice Larkin Walsh, the Supreme Court rejected the defendant’s arguments for any relief. The justices found there was ample evidence that Kelly entered the home without permission with the intent to commit an assault. Furthermore, while the Court reviewed the jury instructions, allegations of prosecutorial error, and police statements used during the trial, it determined that Kelly received a fair trial free from any instance of prosecutorial error, and that his convictions were supported by the evidence and law. The high court’s ruling ensures that Kelly’s life sentence remains in place following his role in a violent home intrusion and shooting.
The appeal was handled for the state by Assistant District Attorney Lance Gillett.

Kelly was originally charged and convicted following a 2021 incident in which he entered a Wichita home, leading to a fatal confrontation. Today’s decision marks the conclusion of the direct appeals process regarding his guilt.
