Police arrest three on drug related allegations

WASHINGTON (AP) — A threat on&nbsp;<a href="https://apnews.com/hub/donald-trump">Donald Trump’s</a>&nbsp;life from Iran prompted additional security in the days before Saturday’s campaign rally, but it was unrelated to the assassination attempt on the Republican presidential nominee, two U.S. officials said Tuesday, as law enforcement warned of the potential for more violence inspired by the shooting.

National Security Council spokesperson Adrienne Watson said officials have been tracking Iranian threats against Trump administration officials for years, dating back to the last administration. Trump ordered the 2020 killing of Qassem Soleimani, who led the Iranian Islamic Revolutionary Guard Corps’ Quds Force.

“These threats arise from Iran’s desire to seek revenge for the killing of Qassem Soleimani. We consider this a national and homeland security matter of the highest priority,” Watson said.

The U.S. Secret Service and the Trump campaign were made aware of the latest threat, prompting a surge in resources and assets, according to the officials, who spoke on the condition of anonymity to discuss sensitive intelligence matters.

The additional resources did not prevent&nbsp;<a href="https://apnews.com/article/trump-rally-assassination-attempt-db24c5bfbbe7d09fa2437c3c836bb434">Saturday attack at a rally in Pennsylvania</a>, where a 20-year-old with an AR-style rifle opened fire from a nearby rooftop, leaving the former president with an ear injury, killing one rallygoer and severely injuring two others.

Watson said there have been no ties identified between the gunman at the rally “and any accomplice or co-conspirator, foreign or domestic.”

“The Secret Service and other agencies are constantly receiving new potential threat information and taking action to adjust resources, as needed,” said Secret Service spokesman Anthony Guglielmi who said he couldn't comment on any specific threats.

Online rhetoric is particularly concerning

Since the rally shooting, rhetoric online has become particularly concerning “given that individuals in some online communities have threatened, encouraged, or referenced acts of violence in response to the attempted assassination,” according to a joint intelligence bulletin by Homeland Security and the FBI and obtained by The Associated Press.

Presidents — and presidential candidates — are always the subject of threats, but the FBI and Homeland Security officials are “concerned about the potential for follow-on or retaliatory acts of violence following this attack,” according to the bulletin released Monday evening. Law enforcement warned that lone actors and small groups will “continue to see rallies and campaign events as attractive targets.”

A visibly stronger security detail now surrounds Trump and President Joe Biden. And independent candidate Robert F. Kennedy Jr. received Secret Service protection in the wake of the shooting.

There were more agents surrounding Biden as he boarded Air Force One to Las Vegas on Monday night.&nbsp;<a href="https://apnews.com/article/trump-republican-national-convention-58c09e396b79751c44baed14a1b432a8">As Trump made his first post-shooting</a>&nbsp;appearance on the floor of the Republican National Convention in Milwaukee that same night, there was a much larger presence than he has previously had, with agents keeping a protective barrier between Trump and the crowd, preventing him from greeting supporters as easily as he usually does.

Show of force, but also an effort to reassure

The visibly stepped-up presence is meant to add a show of force and additional protection, but is also an effort to reassure Americans concerned about the potential for additional violence after the already-tense and vitriolic 2024 election season turned deadly.

The FBI has no clear motive for the shooting and the&nbsp;<a href="https://apnews.com/article/secret-service-trump-rally-4e3415b1461f5acefbc8e1fadad0375b">investigation is ongoing</a>. Biden ordered an independent review of the federal response after questions swirled about how the gunman could have gotten so close to the stage, and how the enhanced security presence did not prevent the attack.

“This attack reinforces our assessment that election-related targets are under a heightened threat of attack or other types of disruptive incidents,” according to the bulletin.

Security will also be enhanced at the&nbsp;<a href="https://apnews.com/article/biden-democrats-trump-reelection-convention-2024-99db6ca0b7df215442b7fc1fd24f4463">Democratic National Convention</a>&nbsp;in Chicago in a few weeks.

The U.S. Secret Service, which is tasked with protecting the president, former presidents, their spouses, some other lawmakers and major security events, has protocols in place that allow for leeway to adjust security needs in the moment. They're constantly monitoring possible threats. Authorities this week arrested a Florida man they say made comments about wanting to kill Biden. The man’s comments, both online and in person at a mental health facility, were made before Saturday’s assassination attempt of Trump, according to court papers.

Federal law provides Secret Service protection to former presidents and their spouses for life. The security posture around ex-presidents varies depending on threat levels and exposure, generally being toughest in the immediate aftermath of their leaving office and getting lower-profile — but never going away — as the years go on.

Trump&nbsp;<a href="https://apnews.com/article/trump-2024-second-term-prosecute-media-b892fd6f3ce721016eb1176e82aa51c3">is the first modern ex-president to seek another term</a>, and because of his high visibility, his protective detail has always been larger than some of his peers. But some were frustrated by the visit, including people being dropped off at a bus stop just in front of the store, and others trying to enter their apartments after work.

At one point, an individual who lived in the building started shouting from a window that was just above the entrance where Trump would eventually stand and give remarks to the cameras and answer reporters' questions.

Biden, too, will often linger long after his events have ended, talking to people. At a campaign rally in Harrisburg, Pennsylvania, last week, he spent nearly an hour in the sun shaking hands, taking selfies and talking to people up close. Earlier in Philadelphia, he was surrounded by churchgoers as they crowded into the pews hoping to speak with him as his agents monitored the crowds and pushed people further back in some cases.

Biden often talks about how hard it is to interact with the public given security concerns.

Iran’s mission to the United Nations called the accusations “unsubstantiated and malicious.”

In a statement obtained by The Associated Press late Tuesday, the mission said that while it sees Trump as a “criminal” who should be punished in court for ordering Soleimani’s assassination, “Iran has chosen the legal path to bring him to justice.”

Other former high-level Trump administration officials also receive protection following Soleimani's assassination. Since taking office, the Biden administration has repeatedly extended 24/7 protection to former Secretary of State Mike Pompeo and his top Iran aide, Brian Hook, due to credible threats on their lives from Iran.

The last time the protection was extended by the State Department was on June 21, according to congressional notifications seen by the AP. As of March 2022, the State Department was paying more than $2 million per month to provide 24-hour security to Pompeo and Hook, though the agency has stopped reporting the cost figures to Congress.

Iran threat prompted more security at Trump rally 

BUTLER COUNTY —A Kansas man man is going to prison for a road-rage beating death of of a man in 2023.&nbsp;

On July 10, Ashton McCoy, 24, was sentenced to 21-years in prison, according to&nbsp;Butler County Attorney's office. In May McCoy pleaded guilty to second-degree murder and aggravated assault.&nbsp;

Just after 1 p.m. October 8, police responded to a reported battery at the Jump Start convenience store in the 1600 block of West Central in El Dorado, according to a media release. First responders found 74-year-old&nbsp; Alton Algrim of Leon, Kansas, with injuries in connection with a road rage incident. EMS transported the victim to a Wichita hospital.&nbsp;

Following an investigation, officers arrested McCoy initially on a requested charge of aggravated battery. The charge against McCoy were amended to first-degree murder following Algrim's death.&nbsp;&nbsp;

SEDGWICK COUNTY —Transportation Security officers at Wichita Eisenhower Airport prevented a loaded firearm from making it on-board an airplane Sunday, according to a social media report from the TSA on Tuesday afternoon.

"During season more travelers are bringing prohibited items in carry-on. Start with empty bag when packing and avoid fines, travel delays and possible arrest."

Travelers face a fine of up to $15,000, suspension of&nbsp; the right to&nbsp; participation in TSAPreCheck, and go through an additional inspection.

Loaded gun found in traveler's bag at Kansas airport

PAWNEE COUNTY—Law enforcement authorities are investigating an alleged sex assault at public pool in Larned.&nbsp;

According to Pawnee County Attorney Doug McNett, on July 11, police were called to the Larned City Pool, 100 West First Street, to investigate an alleged sexual assault of a minor at the pool facility. 

They advised the adult suspect was interviewed at the scene, but no arrest was made at the time due to concerns with the suspect’s mental capacity. 

The crime scene was processed, and staff interviewed. A formal forensic interview will be scheduled with the victim to be performed by the Child Advocacy Center. At this time no formal charging requests have been submitted to the Pawnee County Attorney’s Office.

Police investigate alleged sex assault of child at Kan. public pool

LIBERTY, Mo. (AP) — A Missouri man facing trial on kidnapping and sexual assault charges after a woman said she escaped weeks in his captivity was arraigned Friday on a new charge of murder. Authorities say they linked him to the remains of a woman found in a barrel by the Missouri River.

The case against Timothy M. Haslett gained renewed attention this week when the murder charge was filed. Prosecutors say Haslett killed 36-year-old Jaynie Crosdale. At the same time, police accounts have laid out the extent of the brutality the surviving woman described.

Haslett, 41, appeared in court Friday and entered a plea of not guilty.

The case against Haslett emerged in&nbsp;<a href="https://apnews.com/article/crime-arrests-kidnapping-missouri-fb3dd5739aaa2a2d037f858163adb322">October 2022</a>&nbsp;after a woman told law enforcement she escaped from weeks of torture in his locked basement, according to a probable cause statement. Police said she bore marks on her back from whippings.

The survivor said she met Haslett while walking in a Kansas City area known for prostitution. She said Haslett offered her money, and she agreed to go with him to his home. Once she was in his pickup truck, the woman told law enforcement that he held a gun to her, raped her and forced her to take narcotics.

He then took her to his basement, which police described as a “dungeon” filled with torture devices, cameras and restraints. She said he raped and tortured her every day, and would cut off her breathing.

Police said they found photos of Haslett and two different women taken inside the dungeon room below his single-story home in Excelsior Springs, about 40 minutes northeast of Kansas City. A search of his phone uncovered more than 100,000 photos and videos, mainly screenshots from porn sites, of women being choked, masked and restrained.

A public defender for Haslett had not responded by Friday evening to multiple emails seeking comment.

The woman who survived said Haslett described killing two other women he previously kidnapped: one by suffocating her, and another who died after violent sexual torture.

He told her “if she did not listen to him, he would suffocate her and put her in a barrel like the rest of ‘them,’” according to the probable cause statement.

Haslett's phone also had saved maps of the Missouri River, where Crosdale’s body was found.

Authorities said they had been looking for Crosdale as a potential witness in the case after identifying her in photos found at Haslett's home.

Kayakers in June 2023 found a blue 30-gallon barrel with her remains inside while camping off the river in Saline County, according to police.

Haslett was indicted for first-degree murder in Crosdale's death this week.

He was&nbsp;<a href="https://apnews.com/article/indictments-child-endangerment-missouri-crime-kidnapping-e666d09d04a08170ca843eb6863a080e">previously indicted</a>&nbsp;on one count of rape, four counts of sodomy, two counts of second-degree assault and one count each of kidnapping and endangering the welfare of a child. Haslett is being held in the Clay County Detention Center on $5 million bond.

It's not clear if there is a third victim. The charges filed this week are based on the evidence authorities currently have, and Clay County Prosecuting Attorney Zachary Thompson said the investigation is ongoing. He urged anyone with information to come forward.

“Today’s indictment represents the next step in our pursuit of justice for the victims, the families and our community,” Thompson said Tuesday.

In an&nbsp;<a href="https://www.savoryandsonsfuneralhome.com/obituaries/Jaynie-Crosdale/#!/Obituary">obituary</a>, her family said Crosdale competed in track and field in grade school and “was known for her superior speed in sprints.”

“Her family never stopped looking for her; and although the outcome wasn’t what we prayed for, we found peace in finally being able to properly put her to rest last year,” the family said in a statement. “We find more peace in knowing that we are one step closer to getting her the justice she deserves.”

Family wrote in her obituary that she “accepted Christ at an early age.”

But life was hard for her. She lived on the streets, and struggled with mental illness and drug addiction, said Kris Wade, executive director of The Justice Project KC, who met her through outreach efforts.

She said when she heard Crosdale was missing, she instantly knew she was dead.

“I am really thankful that there will be justice for her and her family,” she said. “That’s the main thing I’m thankful for right now. She was really intelligent, really bright person. She had a lot of issues.”

Thompson says the evidence shows Crosdale was previously arrested for sex work, which was how she and Haslett met.

“In Clay County, regardless of who you are, how much money you have, what the color of your skin is, everyone is entitled to equal protection under the law,” Thompson said Tuesday.

Woman escaped a 'dungeon’ beneath a KC area home, another was killed

SHAWNEE COUNTY —Law enforcement authorities investigating a weekend murder have a suspect in custody.

Just before 11:30a.m. Saturday, police responded to report of a shooting in the 1200 Block of NE Monroe in Topeka, according to Police Lt. Edward Stanley.

First responders located 47-year-old&nbsp;Richard E. Hernandez&nbsp; suffering from a gunshot wound. He was pronounced deceased at the scene. .

As a result of the investigation police arrested 43-year-old John E. Kyhnell and 39-year-old Steve A. Devries both of Topeka.

Kyhnell is being held in the Shawnee County Department of Corrections. Kyhnell is jailed on requested charges of Murder in the 1st degree and Criminal Possession of a Weapon by a Felon. He has previous convictions for aggravated assault, aggravated battery, criminal possession of a weapon by a felon and for drugs, according to the Kansas Department of Corrections.

Devries was originally jailed on a requested charge of Murder in the 1st degree. He is no longer in custody.

Kansas deputy found crack cocaine during traffic stop

SHAWNEE COUNTY –Law enforcement authorities are investigating a Kansas woman with previous convictions of forgery on new forgery allegaions.

On&nbsp;July 10, police responded to a reported fraudulent check at Azura Credit Union, 1129 S Kansas Avenue in Topeka, according to police spokesperson Rosie Nichols.

The bank reported Tina M. Funk, 31, of Topeka, was attempting to cash a check that was fraudulent.

It was then found that Funk had four outstanding warrants. As a result of the investigation, Funk was arrested and booked into the Shawnee County Department of Corrections on requested charges of Forgery; Making or altering a written instrument; unknown conviction, Identity theft, Theft by deception; Value less than $1,500, Theft by deception; Value $1,500 to $25,000 and the Warrants.&nbsp;&nbsp;

Funk has previous forgery convictions in Atchison and Jefferson County. She has an ID theft conviction in Morris County, according to the Kansas Department of Corrections.

The Geary County Sheriff's Department reported that Deputies responded to I-70 mile marker 306 eastbound for a report of a rolling domestic in a passenger car. Deputies were able to locate the vehicle on I-70 at mile marker 318. 

After an investigation Nina Kravtsova of Centerton, Arkansas was arrested on requested charges of Domestic Battery, Aggravated Assault (Domestic), Battery on a Law Enforcement Officer, and Interference with LEO. Kravtsova was later arrested on a requested charge of Battery on a Corrections Officer.

Authorities make arrest on I-70

KANSAS CITY—A suspect is in custody after a violent incident inside a Kansas City hospital.

Just after 9p.m. Friday, police responded to a report of gunshots fired inside St. Luke's hospital, 4401 Wornall Road, according to Officer&nbsp; Alayna Gonzalez.

&nbsp;Security was notified of a subject who entered the hospital and assaulted a staff member. When attempting to take him into custody, the suspect produced a handgun and fired off a shot. 

The suspect was placed in handcuffs until police arrived on scene. There were no injuries as a result of the shot being fired, according to Gonzalez. Police did not release the name of the suspect.

An arrest was made after one man walked into a Kansas City hospital, assaulted a healthcare worker and then fired a gun.

Just after 9p.m. on Friday, emergency crews were called to St. Luke’s Hospital at 4401 Wornall Road with reports of shots fired inside the hospital.

First responders indicated that security was told about an individual who entered the hospital and assaulted a staff member. When they attempted to take him into custody, the man pulled out a handgun and fired a single shot.

KCPD said the man was put in handcuffs until officers arrived. No injuries were reported as a result of the shooting. No further information has been released.

 Police: Staff member assaulted, gun fired inside KC hospital

LOS ANGELES (AP) —&nbsp;<a href="https://apnews.com/hub/shannen-doherty">Shannen Doherty,</a>&nbsp;the “Beverly Hills, 90210” star whose life and career were roiled by illness and tabloid stories, has died at 53.

After years with breast cancer, Doherty died Saturday, according to a statement from her publicist, Leslie Sloane.

“The devoted daughter, sister, aunt and friend was surrounded by her loved ones as well as her dog, Bowie. The family asks for their privacy at this time so they can grieve in peace,” Sloane said Sunday. The news was first reported by&nbsp;<a href="https://people.com/tv/shannen-doherty-dead/">People magazine.</a>

Her illness was publicly revealed in a lawsuit filed in 2015&nbsp;<a href="https://apnews.com/c166828f0b06460f8a200eb36fbe2229">against her former business managers,</a>&nbsp;in which she alleged they mismanaged her money and allowed her health insurance to lapse. She later shared intimate details of her treatment following a single mastectomy. In December 2016, she posted a photo of her first day of radiation, calling the treatment "frightening" for her.

In February 2020, Doherty revealed that the cancer had returned and&nbsp;<a href="https://apnews.com/article/a562d190abee6807c30366d00b991043">she was at stage four.</a>&nbsp;She said she came forward because her health conditions could come out in court. The actor had sued insurance giant State Farm after her California home was&nbsp;<a href="https://apnews.com/article/jury-shannen-doherty-state-far-fire-suit-6ee321978116bd3f951ce1726539b83f">damaged in a fire in 2018.</a>

“I have no idea how long I'm going to be on the chemo for. ... That's not something that I can predict, it's not something my doctors can predict. And it's scary, it's like a big wake-up call,” Doherty said on a late June episode of her podcast “Let's Be Clear,” adding that a recent change in the shape of her cancer cells meant there were new treatment protocols for her to try. “For the first time in a couple months probably, I feel hopeful because there are so many more protocols now, whereas before I was hopeful — but I was still getting prepared.”

A native of Memphis, Tennessee, Doherty moved to Los Angeles with her family at age 7 and, within a few years, became an actor.

“It was completely my decision,” she told The Associated Press in a 1994 interview. “My parents never pushed me into anything. They support me. It really wouldn’t matter if I was a professional soccer player — they’d still be as supportive and loving.”

As a child star, she worked steadily in such TV series as “Little House on the Prairie,” in which she played Jenny Wilder. She detoured as a teenager to the big screen in “Girls Just Want to Have Fun” (1985)&nbsp;<a href="https://apnews.com/general-news-television-e36d952e4e8d44ac87373e32fe4b2dfb">and “Heathers.”</a>

In 1990, the doe-eyed, dark-haired actor won her breakout role as Brenda Walsh in producer Aaron Spelling’s hit teenage melodrama set in posh Beverly Hills. She and Jason Priestley’s Brandon, Brenda’s twin brother, were fish-out-of-water Midwesterners.

But Doherty’s fame came with media scrutiny and accounts of outbursts, drinking and impulsiveness — the latter most notably after a very brief marriage to actor George Hamilton’s son, Ashley. Doherty’s second marriage, in 2002, was to Rick Salomon and was annulled within a year. In 2011, Doherty married photographer Kurt Iswarienko. She filed&nbsp;<a href="https://apnews.com/article/shannen-doherty-divorce-cancer-54cbd739e4792972fbdea21db8fad442">for divorce in April 2023.</a>

She left “Beverly Hills, 90210” at the end of its fourth season in 1994 (the show aired until 2000), reportedly removed by Spelling because of conflicts with her co-stars and chronic lateness.

But in her 1994 AP interview, Doherty described her life as peaceful.

“It must be, if you pick up the Enquirer and find the only thing they can write about me is that I installed a pay phone next to my house and was seen at Stroud’s (a discount bed-and-bath chain) buying $1,400 worth of bed linens and wouldn’t go to an expensive store,” she said. “It must be calm if they’re pulling that stuff out of their heads.”

Three years later, in 1997, Doherty was sentenced to anger-management counseling by a Beverly Hills Municipal Court judge after she allegedly smashed a beer bottle onto a man’s windshield during a quarrel. After a 2001 drunken driving arrest, she pleaded no contest and was ordered to serve five days in a work-release program.

Doherty reunited with Spelling when he cast her in 1998 as Prue Halliwell in “Charmed.” In an AP interview that year, the actor expressed regrets about her past.

“I did bring a lot of it on myself,” Doherty said. “I don’t think I can point fingers and say, ‘Oh, YOU’RE to blame.’ And I don’t do that with myself, either. Because I was just growing up.”

Her personality was “grotesquely misconstrued” by the media, Doherty added.

Spelling said at the time that their relationship was never as bad as some made it seem.

“We had a few bumps along the road, but golly, who doesn’t?” said Spelling, who died in 2006. “Everything Shannen did was blown out of proportion by the rag sheets.”

Doherty starred with Holly Marie Combs and Alyssa Milano in “Charmed” from 1998-2001,&nbsp;<a href="https://apnews.com/article/cb961d8470754ffdb0e0d983247d4a86">at which point her character was replaced</a>&nbsp;by one played by Rose McGowan. Doherty appeared in the “90210” sequel series seven years later and competed on “Dancing with the Stars” in 2010. She also worked on the third “Beverly Hills, 90210” reboot,&nbsp;<a href="https://apnews.com/television-general-news-708b6e9d2513400881d4cdba8d1a319f">“BH90210,” a meta send-up</a>&nbsp;that&nbsp;<a href="https://apnews.com/television-arts-and-entertainment-d415beb2dd784a61a583ec26df7a1843">reunited most of the original cast</a>&nbsp;and aired for one season in 2019.

Doherty struggled to recapture her “Beverly Hills, 90210” star status, but worked in big-screen films including “Mallrats” and “Jay and Silent Bob Strike Back” and in such TV movies as “A Burning Passion: The Margaret Mitchell Story,” in which she played the “Gone with the Wind” author. A nadir was “Blindfold: Acts of Obsession,” an erotic thriller opposite Judd Nelson.

Doherty's lawsuit against her ex-business managers was settled in 2016. She was open about the toll that cancer was taking. She posted photos that showed the baldness that followed treatment and, in an August 2016 interview with “Entertainment Tonight,” shared her fears.

“The unknown is always the scariest part,” she said. “Is the chemo going to work? Is the radiation going to work?” she said. “Pain is manageable, you know living without a breast is manageable, it’s the worry of your future and how your future is going to affect the people that you love.”

Doherty advocated for cancer awareness and care, and spoke to the AP in 2021 about how spending years with the disease affected her life and sense of optimism.

“When you get something like cancer, your tolerance for drama is zero. I don’t like people wasting my time. I don’t like negativity,” she said. “It’s odd because I think if you look back, you’re like, ‘Oh, gosh, it’s so much drama around her,’ but I don’t think I was necessarily into the drama. I just think if we took young 18-year-old Shannon, 19-year-old Shannon, and we took her and planted her like right now, I would be a nerd and nobody would be writing about me.”

KBI: Kansas man accused of child sex crimes

SEDGWICK COUNTY—A Kansas man accused in a deadly shooting in Wichita made his first court appearance in the case last week.

Peter McKinney, 22 of Wichita, is charged with 2nd&nbsp;degree murder, according to the Sedgwick County District Attorney's office.

Police also arrested McKinney's father at the scene on a requested charge of Criminal Possession of a Firearm by a Convicted Felon.&nbsp;&nbsp;More investigation is needed before further charges are filed against him, according to the district attorney's office.

Just after 11a.m. July 1, Sedgwick County Emergency Communications received a call reporting a shooting at the&nbsp;Rockborough apartment complex, 202 N Rock Road in Wichita, according to police spokesman Andrew Ford.

First responders located 25-year-old Sebastian Crawford of Wichita with a single gunshot wound. He was pronounced deceased on the scene.

Multiple other individuals, including two juveniles, were located inside the apartment. EMS transported a woman to an area hospital to be evaluated for a condition apparently unrelated to the shooting.&nbsp;No other injuries were reported.

Homicide investigators responded to the scene and worked with patrol officers to understand what led up to the shooting. According to Sedgwick County booking records, police arrested 22-year-old Peter McKinney and 50-year-old Jeffrey McKinney.

At this time, police believe that Crawford and Peter McKinney knew each other and were involved in an argument before the shooting.

Peter McKinney remains jailed on a half-million dollar bond. His next court hearing is July 15, according to the district attorney's office.&nbsp; His father remains jailed on a $50,000 bond, according to online jail records.

&nbsp;This is the 18th criminal homicide in Wichita this year, according to Ford.

Sheriff: Kansas man accused of selling methamphetamine

BOSTON (AP) — A lawsuit was filed Thursday against Hershey, Walgreens and several others in the case of a Massachusetts teen who died after he participated in a spicy tortilla chip challenge that was widely promoted on social media.

Harris Wolobah, a 10th grader from the city of Worcester, died Sept. 1, 2023, after eating the Paqui chip as part of the manufacturer’s “One Chip Challenge.” An autopsy found Wolobah died after eating a large quantity of chile pepper extract and also had a congenital heart defect.

Harris died of cardiopulmonary arrest “in the setting of recent ingestion of food substance with high capsaicin concentration,” according to the autopsy from the Chief Office of the Medical Examiner. Capsaicin is the component that gives chile peppers their heat. The autopsy also said Harris had cardiomegaly, meaning an enlarged heart, and a congenital defect described as “myocardial bridging of the left anterior descending coronary artery.”

“Today we filed a wrongful death lawsuit on behalf of this wonderful family for the loss of their beloved son, Harris,” said Douglas Sheff, one of the attorneys representing the family in the lawsuit filed in Suffolk Superior Court. The lawsuit seeks a judgement determined by the court that would include punitive damages.

Sheff said the parties created “a perfect storm” that led to Wolobah's death that included Paqui producing the spicy chip and encouraging people to post videos of themselves eating the chip on social media while the lawsuit alleged Walgreens sold the “poisonous chip” to children.

“The defendants charged about $10 for each chip, $10 for the chip that killed Harris, $10 for his life,” Sheff said. “Isn’t it clear that these defendants knew full well that this chip was unreasonably dangerous? And isn’t this an obvious marketing campaign designed to attract kids to that very danger?”

Lois and Amos Wolobah, the parents of Harris, attended the news conference but did not speak. But at several points, Amos Wolobah appeared to become emotional and Lois seemed to blow a kiss to a photo that was shown of Harris.

The autopsy said Harris Wolobah had cardiomegaly, meaning an enlarged heart, and a congenital defect described as “myocardial bridging of the left anterior descending coronary artery.” But Sheff was adamant that had nothing to do with his death.

“The chip is what killed him,” he said.

Paqui, a Texas-based subsidiary of the Hershey Co., has expressed its sadness about Wolobah's death but also cited the chip’s “clear and prominent labeling highlighting that the product was not for children or anyone sensitive to spicy foods or with underlying health conditions.”

The Paqui chip, sold individually for about $10, came wrapped in foil in a coffin-shaped box containing the warning that it was intended for the “vengeful pleasure of intense heat and pain.” The warning noted that the chip was for adult consumption only, and should be kept out of the reach of children. After seeing reports of teens and others not heeding those warnings, the company said it worked with retailers to “voluntarily remove the product from shelves in September 2023, and the One Chip Challenge has been discontinued.”

A spokesperson for Walgreens said it had no comment on the lawsuit while Hershey's did not immediately respond to a request for comment.

Despite the warning, children had no problem buying the chips, and there had been reports from around the country of teens who got sick after taking part in the chip-eating challenge. Among them were three California high school students who were taken to a hospital and seven students in Minnesota who were treated by paramedics after taking part in the challenge in 2022.

The challenge called for participants to eat the Paqui chip and then see how long they could go without consuming other food and water. Sales of the chip seemed largely driven by people posting videos on social media of them or their friends taking the challenge. They showed people, including children, unwrapping the packaging, eating the chips and then reacting to the heat. Some videos showed people gagging, coughing and begging for water and the lawsuit cites scores of examples of people becoming sick after eating the chip.

Harris Wolobah's death spurred warnings from Massachusetts authorities and physicians, who cautioned that eating such spicy foods can have unintended consequences. Since the chip fad emerged, poison control centers have warned that the concentrated amount could cause allergic reactions, trouble breathing, irregular heartbeats and even heart attacks or strokes.

Lawsuit filed: Teen died after eating spicy chip, part of online challenge

PAWNEE COUNTY– James Speer, 32, formerly of Larned appeared in the Pawnee County District Court this week for trial regarding two alleged Jessica’s Law sexual offenses alleged to have occurred in 2013, according to Pawnee County Attorney Doug McNett.

The matter was originally scheduled to be presented to a jury, but Speer waived his right to a jury trial on July 3, 2024, and asked to proceed with a bench trial. 

Pawnee County District Judge Bruce Gatterman presided over the bench trial. Prior to trial, the defendant gave the State notice of his intent to rely on an alibi defense.

She stated the assault occurred when a man asked her to sit on his lap near a bonfire. The girl also told her mother that they ultimately spent the night at the party because her father had been drinking heavily. After she had fallen asleep, the victim remembered being awakened to find the same man’s face and he was assaulting her. The victim told her mother that she did not know that man that did it, but she would “definitely remember his face if she saw it again.”The mother testified at trial that after her daughter’s disclosure she reached out to the girl’s father and was able to determine the party in question occurred sometime in 2013 in Garfield, Kansas. While the father could not remember the names of the men at the party, he did remember the names of a couple woman that he had attended the party with. The mother further testified that she utilized social media to reach out to the women. One of the women responded to her and gave her the names of two men at the party, one of whom was James Speer. The mother was able to obtain pictures of Speer and the other man and sent the photos to her daughter electronically. The girl testified at trial that when she opened the photo of the other man, she thought it kind of looked like the assailant, but not exactly. However, when she opened the photo of Speer she instantly couldn’t breathe, and she had a panic attack.The Pawnee County Sheriff’s Department was then notified about the allegations by the mother after the victim identified James Speer as her assailant. A formal forensic interview of the girl was performed by the Child Advocacy Center in Great Bend, Kansas.Law enforcement testified at trial their investigation revealed that the father had in fact learned of the allegation the day following the party and had told the women he had attended the party with about the allegation. His daughter, however, later downplayed the actual touching after the father said he was going to kill the man. As such, the father never notified law enforcement.When law enforcement interviewed the two women identified by the father, they learned that one of the two women had been the live-in girlfriend of James Speer at the time of the party. Both women testified that Speer was at the party, that they saw the girl on his lap, that Speer was the only person’s lap the girl sat on, and that they had also saw Speer carry the girl into the house after she fell asleep. They further testified the other man identified at the party had left before anyone had gone to bed. The other man identified at the party died in 2015. The victim’s father also testified at the trial about remembering Speer being at the party and how his daughter had sat on Speer’s lap.Additionally, law enforcement discovered that after Speer’s girlfriend learned about the allegation against Speer the day following the party in question, the woman immediately took her own daughter, who was two year old at the time, to the Pawnee Valley Community Hospital (PVCH) for a sexual assault exam. The medical records reflected that the exam took place on May 26, 2013. The records also indicated the exam was being requested due to an allegation that the child’s mother’s boyfriend, James Speer, had put his hands on a 7 year old girl the night before. The records also indicated that the mother lived with James Speer in Garfield but did not intend to return to the home. Based on the information provided, PVCH made referrals to law enforcement and DCF.A current detective for the sheriff’s department assigned to the case testified that based on his review of the file it appeared no follow-up was done on the referral as Speer was arrested on July 2, 2013, and subsequently charged with having a sexual relationship with a 14 year old girl. Speer has been in custody since that time.As part of the evidence at trial, the parties stipulated that in 2015 a jury of twelve persons convicted, James Edwin Speer, of two counts of aggravated indecent liberties with a 14 year old child. Specifically, the jury found (1) James Edwin Speer had sexual intercourse with a 14 year old child in an apartment in Larned, Kansas, on or about 24th day of May to on or about the 7th day of June, 2013; and (2) James Edwin Speer had sexual intercourse with a 14 year old child in an apartment in Larned, Kansas, on or about 7th day of June to on or about the 30th day of June, 2013.Following the presentation of the State’s case, the defendant took the stand on his own behalf. Speer testified that he had not been at the party in question as he had already moved out of the home on May 1st and that based on the evidence presented at the jury trial in his 2015 conviction it was impossible for him to have committed the crimes currently charged as he was having a sexual relationship with the 14 year old during that time frame. Defense counsel then asked in support of their alibi defense that the Court to take judicial notice of the trial testimony of the prior jury trial.The parties presented closing arguments on Wednesday morning.&nbsp;On Wednesday afternoon Judge Gatterman announced that as the trier of fact he found the victim’s identification of Speer being her assailant persuasive and when combining that with the eyewitness testimony placing Speer at the party, the victim being on Speer’s lap, and there being no other identifiable possible perpetrator, the Court found the State had proven beyond a reasonable that on or about May 25 or 26, 2013, in Pawnee County, Kansas, the defendant James Edwin Speer had sexual intercourse as defined by Kansas law and then engaged in oral sodomy as defined by Kansas law with a child under the age of 14 years of age at a time when the defendant was 18 years of age or older. Accordingly, the Court found the defendant guilty of Rape of a Child Under 14 years of age and guilty of Aggravated Oral Sodomy of a Child Under 14 years of age.Following the reading of his verdicts, Judge Gatterman advised Speer of his duty to register as sex offender under the Kansas Offender Registration Act and ordered a presentence investigation report be completed to determine the defendant’s criminal history. Sentencing will be scheduled for a later date.Under the Kansas Sentencing Guidelines, Speer faces a presumptive prison sentence between 147 months and 653 months in the custody of the Department of Corrections depending on his criminal history. Based on his prior sex offenses, Speer now also faces the possibility of a mandatory 40 year sentence under the Jessica’s Law sentencing provisions.Speer is currently in the custody of the Kansas Department of Corrections serving a sentence for his 2015 convictions.Pawnee County Attorney Douglas McNett presented the State’s case.
