(AP) — A man who claims he was banished from Kansas as a condition of a plea deal could be allowed back in the state under an agreement reached Monday, although a county prosecutor disputes that he was ever banned from returning.The American Civil Liberties Union of Kansas said in a news release that it has agreed to drop a civil lawsuit brought on behalf of&nbsp;<a href="https://apnews.com/a137c9cada1a421bbda8ea0d5c046d0d" rel="noopener noreferrer" target="_blank" style="color: rgb(28, 167, 218);">Bo Dana Rupert</a>&nbsp;in exchange for an amended Montgomery County plea agreement in a related criminal case against him. Court transcripts show Rupert pleaded no contest in 2017 to three felony counts of making a criminal threat and three misdemeanor counts of filing a false report. He was sentenced to 12 months of probation, and the judge accepted a plea agreement under which Rupert agreed to leave Kansas and never return. It is unclear from the court transcript whether the judge intended to specifically include that provision as part of his sentence. That 2017 plea agreement explicitly stated Rupert was not to return to Kansas: “If the defendant does return to Kansas then the terms of this agreement have been violated and the County Attorney may consider filing all other charges for additional offenses not filed now.” But on Monday, Montgomery County Attorney Larry Markle vehemently pushed back against the ACLU’s claim that Rupert was banished. Markle shared with The Associated Press a sworn affidavit from Rupert’s criminal defense attorney stating it was Rupert who came up with the idea to put a stipulation in the plea agreement that he transfer his probation to another state and not return to Kansas, or risk new charges.“The bottom line is that Rupert was not ‘BANISHED,’” Markle said in an email. Rupert left Kansas the day after his sentencing and has never returned, according to the ACLU. The group said in its filing that his then attorney advised him: "Don't still be here tomorrow when the sun comes up." That attorney, Heath Lampson, disputes ever giving him that advice. Two weeks after he was sentenced, Montgomery County issued an arrest warrant for Rupert stating he had violated the terms of his probation by not attending his probation meetings in Kansas. The ACLU said in a court filing that the banishment was reminiscent of punishments in the days of the Wild West, when convicted criminals were dropped at the state line and warned to never return in a practice called "sundown probation;" and in ancient Greece, where people convicted of homicide or embarrassing military defeat were sent into exile. Rupert contends in a court filing that he has been unable to return to Kansas for fear of violating the plea agreement.Under the civil settlement, Markle agreed not to prosecute Rupert for being an absconder. Markle said court probation officers were ready to testify under oath that they specifically told Rupert he could not leave the state until the interstate process had been completed for his probation. He released to AP a recording in which Rupert can be heard telling a law enforcement official that he was leaving Kansas for a good-paying job in Texas, but that he felt he was being run out of town by police harassment. “The ACLU either failed to properly investigate this case before filing suit and/or failed to educate themselves on criminal procedure before filing suit, which contains numerous false allegations against the Montgomery County Attorney’s office,” Markle wrote. “The ACLU is more concerned with headlines than the truth.” “We hope attorneys on both sides will think twice before adding stipulations like this one to ... agreements in the future,” Lauren Bonds, legal director for the ACLU of Kansas, said in a news release. “This was an unusual situation, to say the least.” In court filings, Markle argued that Rupert never claimed that the county attorney had ever tried to enforce the offending provision.The ACLU issued a news release stating it was Lampson who prepared the “problematic terms of the plea agreement, not Markle.”Lampson did not immediately return a message seeking comment.

Man who says he was banned from Kansas may return after deal

Just before 6 a.m. Saturday, police were dispatched to a shooting call at a residence in the 1200 block of South Main in Wichita, according to officer Charley Davidson. Upon arrival, officers located 24-year-old John Buess-Wheeler of Augusta inside of the residence with a gunshot wound to his chest. Buess was transported to an area hospital where he died, according to Davidson. A short time later, officers learned that a second victim, a 25-year-old man, drove himself to an area hospital. He was treated for non-life threatening injuries. The investigation revealed there was a physical disturbance between a suspect identified as 20-year-old Carver Soliman, Buess-Wheeler and the 25-year-old man who are known to each other. During the disturbance, Soliman fired a handgun, fatally wounding Buess and striking the 25-year-old victim in the arm. Soliman was located inside the residence by officers and was arrested without incident. The shooting was not a random incident and is believed to be drug-related, according to Soliman. He is being held on a $250,000 bond for second-degree murder and aggravated battery with a deadly weapon, <a href="https://ssc.sedgwickcounty.org/sheriffinmates/SheriffInmateDetail.aspx?nameId=20064278" rel="noopener noreferrer" target="_blank">according to online jail records.</a>

Just before 8 p.m. Friday, an officer at the intersection of South Broadway Boulevard and West Crawford Street in Salina observed a northbound dark-colored passenger car with a temporary tag and without its lights on making a left turn onto West Crawford Street, according to Salina Police Captain Paul Forrester. The officer initiated a traffic stop and the car stopped in the 700 block of Cherokee Drive. As the officer got out of the patrol car, the suspect car took off south on Cherokee Drive and then turned right on Choctaw Avenue, heading back to West Crawford Street at speeds of up to 60 mph, he said. The car then headed west on West Crawford Street, and as it crossed Interstate Interstate 35, it accelerated to 95 mph, according to Forrester. At that point, the officer terminated pursuit. Then just before 2a.m. Sunday, an officer spotted a 2006 black Nissan Altima with a 60-day tag traveling southbound in the 600 block of South Fifth Street, Forrester said. The vehicle turned west onto West Crawford Street with the officer following, he said. The officer attempted to make a traffic stop at West Crawford Street and Whittinghill Avenue, but the Altima accelerated to speeds in excess of 80 mph and continued west on West Crawford Street. The officer terminated pursuit in the 2700 block and a Saline County Sheriff's deputy picked up the pursuit until the suspect driver identified as Kristopher Allen, 22, Salina, lost control and traveled into the ditch in the 4000 block of West Crawford Street, according to Saline County Sheriff Roger Soldan. The car became stuck in the ditch and had to be towed from the scene. Deputies arrested Allen who was not injured, on requested charges that include, Flee and elude, Possession of methamphetamine, Possession of marijuana, Possession of drug paraphernalia, Driving while suspended and Speeding. He has previous convictions for drugs and criminal possession of a weapon, according to the Kansas Department of Corrections.

On October 22, Jackson County Sheriff’s Office investigators and deputies served a search warrant on the home a home in rural Mayetta, according to Sheriff Tim Morse. During the search warrant, law enforcement interviewed 63-year-old Ronnie Jack Dinger, and collected evidence from the scene. Deputies arrested Dinger November 27 on a Jackson County District Court warrant for rape, aggravated indecent liberties to a child under sixteen years of age and aggravated indecent liberties to a child under 14 years of age, according to Morse. Dinger was booked into the Jackson County Jail where and was later released after posting bond. He is expected to make a court appearance this week.

KANSAS CITY (AP) — Authorities are investigating three weekend homicides in Kansas City. Kansas City Police spokesman Jacob Becchina said one man was found shot inside an apartment Sunday. Two other victims were found lying in the street in two separate incidents on Saturday.Becchina says one person is in custody in connection with the man found in an apartment near East 29th Street and Prospect Avenue, but no arrests had been made in the other two homicides.One man was found lying in the street near 38th Street and Monroe Avenue around 4:30 p.m. Saturday. Another man was found near Gregory Boulevard and Flora Avenue with gunshot wounds around 7:30 p.m. Saturday.The victims’ names were not immediately released.___

Just before 5 p.m. Friday, a deputy sheriff attempted to stop a vehicle for a traffic infraction near 158th&nbsp;and R. Road on the south edge of Mayetta, according to Jackson County Sheriff Tim Morse. The vehicle then fled northbound through the City of Mayetta and north on R. Road. The vehicle came to a T intersection at 182nd&nbsp;Road where the vehicle slid off the roadway into a muddy field. The vehicle managed to exit the field and went west on 182nd&nbsp;Road and met deputies east of Highway 75 on 182nd&nbsp;Road. The vehicle came to a stop and the four occupants surrendered to law enforcement. Two of the vehicle’s occupants were taken into custody. The driver, a juvenile, was arrested for possession of a hallucinogenic drug, possession of drug paraphernalia, felony fleeing and eluding a law enforcement officer and reckless driving, according to Morse. In addition, the juvenile had been entered as a missing person and had an outstanding felony warrant out of Shawnee County for vehicle burglary and theft of a firearm. The adult identified as Dathan Aaron Horn, 18, of Topeka was arrested for possession of a controlled substance and possession of drug paraphernalia. The two remaining occupants were released at the scene.

JACKSON COUNTY — Law enforcement authorities are investigating 2 suspects on theft chargesAt approximately 1:30a.m. Friday, a Jackson County Sheriff’s Deputy stopped a 2007 Chevy Trailblazer on 150th&nbsp;Road west of Mayetta for a traffic infraction, according to Sheriff Tim Morse. The driver Eric Dean McCracken, 36, of Topeka was arrested at the scene for driving while suspended and was transported to the Jackson County Jail. Shortly before 5 am, the Jackson County Sheriff’s Office was notified by the Shawnee County Sheriff’s Office of a stolen 2015 Chevy Silverado that they were tracking by GPS. The stolen vehicle was headed north on U.S. 75 Highway. An off duty Jackson County Sheriff’s Deputy in his personal vehicle began following the vehicle into Holton where a Holton Police Officer attempted to stop the vehicle on Banner Road. The vehicle fled driving through yards and stopped behind the former Country Mart Store where the driver exited the vehicle and fled on foot. Deputies and Holton Police Officers set up a perimeter north of Banner to 3rd&nbsp;Street. A Jackson County Sheriff’s K-9 began to track the suspect when, Undersheriff Darrel Chapman observed the suspect inside the Casey’s General Store on Arizona Street. <img src="https://media.eaglewebservices.com/public/2019/11/1575058163319.png">Keith Ray McCracken, Depties and Police Officers arrived and took the man identified as Keith Ray McCracken, 32, of Topeka and is the brother of the earlier suspect, Eric Dean McCracken. It is believed that the younger McCracken was traveling to the Jackson County Jail to post bail on his older brother in the stolen vehicle. The Sheriff’s Office checked with Jefferson County authorities in regard to the Trailblazer that Eric McCracken was arrested in since it was not registered to McCracken, but was registered to a Meriden address. The owner of the Trailblazer was not aware his vehicle was missing at the time of the stop and later reported it stolen. Both brothers are in the Jackson County Jail awaiting bond. Eric Dean McCracken was booked into the jail for driving while suspended and possession of stolen property. Keith Ray McCracken is being held for fleeing and eluding a law enforcement officer, reckless driving, driving while suspended and possession of stolen property.

During the traffic stop, an NSP K9 detected the presence of a controlled substance in the vehicle. Troopers searched the vehicle and discovered 169 pounds of marijuana. The driver, Khamla Bongxay, 31, of Milwaukee, Wisconsin, was arrested for possession of marijuana – more than one pound, possession with intent to deliver, and no drug tax stamp. He was lodged in Hall County Jail. Thursday morning at approximately 10:45 a.m.MT, a trooper observed an eastbound Infinity Q50 speeding at mile marker 2 on Interstate 76. During the traffic stop, the trooper detected criminal activity and performed a search of the vehicle. During the search, troopers found 20 pounds of marijuana, THC edibles, and a handgun. The driver, Jimmy Fabian, 26, of Madison, Wisconsin, was arrested for possession of marijuana – more than one pound, possession with intent to deliver, possession of a firearm during a felony drug offense, and no drug tax stamp. He was lodged in Cheyenne County Jail.

Troopers seize 190 pounds of pot during Thanksgiving traffic stops

OSAGE COUNTY — Law enforcement authorities continue their now three-week investigation in connection with a woman who was found bound and unconscious in a vehicle in Douglas County. In the early morning hours of&nbsp;November 3, investigators from Osage County responded to the former Wakarusa Valley school building southwest of Lawrence, according to the sheriff’s department. The incident started in Osage County and none of the crimes involved occurred in Douglas County, according to the sheriff's department. It also had no connection to the school district or school property, according to USD 497. Law enforcement just found the vehicle parked there. In over 3-weeks, authorities have released no additional details in the case including the health of the victim. Many agencies including Topeka Police, Kansas Bureau of Investigation and Douglas County Sheriff’s Office are participating in the investigation, according to Osage County Sheriff Laurie Dunn. Just after 5 a.m., Sunday, police were dispatched to a shooting call at the Countryside Inn located in the 800 block of South Broadway in Wichita, according to officer Kevin Wheeler. Upon arrival, officers located the victim identified as Timothy Austin who had been shot once in the upper body. He was transported to a local hospital in critical condition and died. <img src="https://media.eaglewebservices.com/public/2019/11/1575057753591.png">Jeremy Pelican photo from a previous arrest in Crawford County BARTON COUNTY, Mo. –&nbsp;The Kansas Bureau of Investigation (KBI) and the Missouri State Highway Patrol (MSHP) Division of Drug and Crime Control are investigating an officer involved shooting which occurred following a police pursuit that began in Pittsburg, Kan., according to a media release from the KBI.&nbsp;Preliminary information indicates that at approximately midnight on Friday, Nov. 29, an officer from the Pittsburg Police Department attempted to make a traffic stop near Quincy St. and Broadway St. in Pittsburg on a 2007 Toyota Camry. The officer initiated the car stop because the tag came back registered to a different vehicle. When the vehicle’s driver failed to stop, a police pursuit ensued.&nbsp;The fleeing vehicle became disabled near the intersection of E. 540th&nbsp;Ave. and S. 270th&nbsp;St., along the Kansas and Missouri state line. The driver then exited his vehicle carrying a shotgun and ran east into a field. The officer pursued the suspect on foot into Barton County, Mo. where a shooting occurred and the suspect was struck.&nbsp;The subject, later identified as 34-year-old Jeremy Pelican of Pittsburg, was transported to Ascension Via Christi Hospital in Pittsburg where he died of his injuries. No law enforcement officers were injured during the incident.&nbsp;The MSHP will lead the officer involved shooting investigation as the shooting occurred in their jurisdiction. The investigation is ongoing. No further information will be released at this time.

Police pursuit in Kansas ends in fatal shooting in Missouri

Just before 9:30 a.m. Wednesday, the Shawnee County Sheriff’s Office responded to a hit and run accident with minor injuries call in the 6100 block of NW Valencia Road in rural Shawnee County, according to Cpl. Jason Mills. The suspect vehicle was located abandoned near NW 62nd and Hoch Road. The driver was identified by an eye witness as a white male. The Sheriff’s Office attempted to deploy a drone for assistance, however the windy weather prohibited the drone to take flight. Law enforcement officers from the Sheriff’s Office, Kansas Highway Patrol, and the Silver Lake Police Department continued to search the area. At approximately 1130p.m., a citizen reported their Jeep stolen in the 5800 block of NW Hoch Road. Just before noon, a citizen reported an abandoned Jeep in the 3700 block of SW Worwick Town Road and a white male seen going behind nearby residences. A Sheriff’s Office K9 tracked the suspect to a residence nearby on SW Nottingham Road. The suspect was safely located inside and taken into custody. The suspect, identified as 34-year-old Steven M. Rule was arrested and booked into the Shawnee County Department of Corrections on a felony theft charge, according to Mills.

Just after 5 a.m., Sunday, police were dispatched to a shooting call at the Countryside Inn located in the 800 block of South Broadway in Wichita, according to officer Kevin Wheeler. Upon arrival, officers located the victim identified as Timothy Austin who had been shot once in the upper body. He was transported to a local hospital in critical condition and died. TIJUANA, Mexico (AP) — Nkeze wasn’t home when Cameroonian militants came knocking, probably to deliver their signature ultimatum to join their separatist movement or have his writing arm cut off. The 24-year-old economics student escaped to Douala, the country’s largest city, only to learn that the government wanted to arrest him for participating in a university protest. He then flew to Ecuador and traveled through eight countries to the U.S. border with Mexico, including a trek through Panamanian jungle where he saw corpses and refugees crying for shelter, food and water. In his quest to settle with relatives in Houston, Nkeze now faces a potentially insurmountable obstacle: a new American ban forbids anyone from applying for asylum at the U.S.-Mexico border if they traveled through another country to get there. “When you find yourself on U.S. soil, you are well-protected,” Nkeze said, sounding upbeat as he waited in Tijuana for a chance to make his case. “You are protected by human rights.” He spoke to The Associated Press on the condition that he be identified only by his last name due to safety concerns. The U.S. is increasingly aligning itself with wealthy countries in Europe and elsewhere to make asylum a more distant prospect.On Thursday, American authorities sent a Honduran man from El Paso, Texas, to Guatemala. It marked the first time the U.S. government directed an asylum-seeker back to that country under the new policy, which gave him an option to file a claim there. He decided against filing a claim and returned to Honduras, according to Guatemala’s foreign ministry. Asylum was once almost an afterthought, until an unprecedented surge of migrants made the United States the world’s top destination in 2017, according to the&nbsp;<a href="https://www.unhcr.org/5b27be547.pdf" rel="noopener noreferrer" target="_blank" style="color: rgb(28, 167, 218);">United Nations Refugee Agency</a>. The U.S. held its leading position&nbsp;<a href="https://www.unhcr.org/globaltrends2018/" rel="noopener noreferrer" target="_blank" style="color: rgb(28, 167, 218);">last year</a>, followed by Peru, Germany, France and Turkey. Nearly half of the roughly 1 million cases in backlogged U.S. immigration courts are asylum claims, with most from Guatemala, El Salvador and Honduras. Trump has called asylum “a scam” and declared that the country is “full.” In nine months, the administration returned more than 55,000 asylum-seekers to Mexico to wait for their cases to wind through U.S. courts. Another asylum ban on anyone who crosses the border illegally from Mexico is temporarily blocked in court.It’s unclear how the ban will be rolled out. The U.S. Homeland Security Department did not comment on Thursday’s initial flight, which got a bare-bones announcement from Guatemala’s foreign ministry. The U.S. has struck agreements with Guatemala, El Salvador and Honduras that aim to send back asylum-seekers who pass through their countries, but the Central American nations are woefully unprepared to accept large numbers.The U.N. It isn’t intended for people who migrate for economic reasons, but many consider it their best hope of escaping poverty and violence. The U.S. isn’t alone in asking other countries to block migrants. After about 1 million refugees traveled through Turkey and Greece to seek safety in Europe, the European Union agreed in 2016 to pay Turkey billions of euros to keep them in refugee camps. The EU has also funded the Libyan Coast Guard to stop Africans from crossing the Mediterranean, where thousands have drowned. Libyan forces have kept refugees in squalid conditions and inflicted torture.Since 2001, Australia has intermittently blocked boats from Asia and detained asylum-seekers on Christmas Island, a tiny Australian territory, or sent them to Papua New Guinea and Nauru, an island nation of 10,000 people. Australia pays detention costs. The U.S. long resettled more refugees than any other country, raising its ceiling to 110,000 during President Barack Obama’s last year in office. That practice has been sharply curtailed since Trump took office, with the country planning to resettle no more than 18,000 refugees in 2020. “There’s this race to the bottom around the world, and governments are looking to each other and trying to figure out what’s the harshest policy they can get away with,” said David FitzGerald, a sociology professor at University of California at San Diego and author of “Refuge Beyond Reach: How Rich Democracies Repel Asylum-seekers.” Cameroonians hoping to follow Nkeze’s path face mounting obstacles. Ecuador, the main gateway from Europe, began requiring visas for Cameroonians and 10 other nationalities in August, including six in Africa. Under heavy pressure from Trump, Mexico is bottling up Cameroonians and other U.S.-bound asylum-seekers near its southern border with Guatemala. Nkeze walked through Panama’s remote, mostly roadless Darien Gap in less than four days on his way to the U.S. After giving his tent and raincoat to a woman who was clinging to life, he slept on a stone and prayed for clear skies and morning light. Only about a dozen in his group of 40 men could keep up in a race to a refugee camp on the other side of the jungle. When his 20-day transit permit in Mexico expired, Nkeze helped a friend at a Tijuana juice factory for a cut of his earnings and lived at a no-frills hotel in the city’s red-light district. Even before the ban, asylum was difficult to get in the U.S. Judges granted only 21% of cases, or 13,248 out of 62,382, in the 2018 fiscal year. Nkeze can also ask for two variations of asylum, but they are even harder to obtain, with 3% succeeding under “withholding of removal” law and only 2% under the U.N. Convention Against Torture. “They essentially want you to bring a note from your torturer before they are willing to let you stay in the U.S," said Stephen Yale-Loehr, professor of immigration law practice at Cornell University.Nkeze may have caught a break when a federal judge in San Diego ruled Tuesday that anyone who appeared at a U.S. border crossing before the ban was announced July 16 and waited for their names to be called should be exempt. He waited for five months in Tijuana for his turn on a list of nearly 9,000 people seeking asylum at a San Diego border crossing.When his name was finally called Nov. 12, he wore a Mexican flag pin on the chest of his jacket as Mexican authorities escorted him to U.S. border inspectors. Fifty-seven-year-old Larry Dinwiddie, of Marshfield, was also charged with abandonment of a corpse and armed criminal action in Cynthia Dinwiddie’s death. He is jailed on $1 million bond. No attorney was listed for him in online court records. Webster County Sheriff Roye Cole said managers at the storage facility on the outskirts of the small town of Marshfield found the body Monday in a freezer that was plugged in and padlocked shut after the man fell behind on rental fees. Marshfield is located about 175 miles (280 kilometers) southeast of Kansas City. Cole wrote in the probable cause affidavit that a person who worked at the storage unit then contacted Dinwiddie and encouraged him to remove the freezer from the storage unit where it had been kept for more than six months. The employee said the freezer wasn’t working and was beginning to smell. Dinwiddie was arrested around 2 p.m. Tuesday when he showed up at the facility with friends to get the freezer. The affidavit said Dinwiddie described his wife as “an abusive alcoholic” and alleged that she threw a hammer at him during an argument. He said he couldn’t take it anymore and hit her with “everything” he could.“After killing her, he was scared and didn’t know what to do with her body, so he drug her to the freezer and put her in it,” the affidavit said. Asked why he kept the corpse in the freezer for four years, Dinwiddie said he “just didn’t know what to do.” He said friends helped him move the locked freezer from his old house to the storage unit without knowing a person was inside. A man who answered the phone at the storage facility declined to answer questions.Cole said an autopsy will be conducted Monday after her body defrosts.Authorities said there was no indication the woman had been reported missing. Jason McCaleb, 44, is charged with first-degree murder in the stabbing death of 28-year-old Devin Cook. Just after 4a.m. Saturday, police responded to a domestic disturbance call at a residence in the 2400 Block of South Washington in Wichita, according to Police Captain Brett Allred.&nbsp;There was a verbal disturbance between McCaleb and his roommate Cook and no crime had been committed. After officers left, a physical altercation occurred between the two in a dispute over how long she had lived at the residence, according to officer Charley Davidson. She had been living there for a month and McCaleb wanted her removed. When police returned a second time, they arrested McCaleb as he left the residence and found Cook inside the home with multiple stab wounds. She was transported to a local hospital where she died. McCaleb is being held on a $700,000 bond, <a href="https://ssc.sedgwickcounty.org/sheriffinmates/SheriffInmateDetail.aspx?nameId=205181" rel="noopener noreferrer" target="_blank" style="color: rgb(0, 0, 255); background-color: rgb(255, 255, 255);">according to online jail records.</a> ----------------SEDGWICK COUNTY — Law enforcement authorities are investigating a fatal stabbing and have made an arrest. He was later arrested and is being held on a $500,000 bond on requested charges of premeditated first-degree murder, <a href="https://ssc.sedgwickcounty.org/sheriffinmates/SheriffInmateDetail.aspx?nameId=205181" rel="noopener noreferrer" target="_blank">according to online jail records.</a> &nbsp;There were no other injuries, and this was not a random incident. Name of the victim has not been released.

Kansas man charged with woman's fatal stabbing 

COWLEY COUNTY — Law enforcement authorities are investigating a burglary and asking the public for help with information. Just after 11p.m. Monday, a police officer noticed damage at the Ark Veterinary Associates building, 907 E. Kansas Avenue in Arkansas City, according to a media release. A building check revealed evidence of a burglary. Initial reports indicate that money and video recording equipment were stolen from the business. Anyone with information about this crime is asked to contact the Arkansas City Police Department at (620) 441-4444. Those wishing to remain anonymous may contact Cowley County Crime Stoppers, which offers rewards of up to $2,500 for information leading to an arrest.

Eduardo Gallardo, 18, and Jesus Alvarez-Medina, 20, were charged Friday with first-degree murder, criminal discharge of a firearm and aggravated assault for the August shooting death of 17-year-old Ramiro Valdez. Just after 2:30 a.m. August 4, police responded to a shooting call in the 900 block of East Central in Wichita, according to officer Charley Davidson. At the scene, police located a a 2003 blue Chevy Silverado driven by Valdez. He had sustained a gunshot wound and was transported to an area hospital where he died, according to Davidson.&nbsp;There were two other teenagers in the truck who were not injured. The investigation has revealed the Silverado was eastbound on Central and was followed by a black pickup truck driven by 18-year-old Eduardo Gallardo. A suspect from the black truck fired multiple times at the Silverado, striking Valdez. Gallardo is one of three charged in the murder. Gallardo was arrested the day of the shooting but had been out of jail. Police arrested him again Saturday, according to the Sedgwick County booking report. He is<a href="https://ssc.sedgwickcounty.org/sheriffinmates/SheriffInmateDetail.aspx?nameId=20062652" style="color: rgb(44, 44, 44);"> jailed on $500,000 bond.</a> Police have not arrested Alvarez-Medina. This incident was not random and is in reference to an ongoing gang feud, according to officer Charley Davidson.

Just before 3p.m. Monday, police were dispatched to 502 Coronado in Hutchinson in reference to a man threatening a Cox Communications employee with a firearm, according to a media release. When officers attempted to speak with this suspect, he retreated and barricaded himself inside his residence. The Hutchinson/Reno County Emergency Response Team was brought to the scene, and negotiators attempted to contact the suspect but were unsuccessful. Different tactics were used, and the suspect identified as Gregory A. Kallaus, 53, was taken into custody without further incident. Kallaus, was arrested on requested charges that include Felony Interference, Criminal Possession of a Firearm, Aggravated Assault and Criminal Threat. The Hutchinson Police Department was assisted by the Reno County Sheriff Office, South Hutchinson Police Department, Kansas Highway Patrol, Hutchinson Fire Department, Reno County EMS and the City of Hutchinson Public Works.

A special prosecutor is an attorney appointed to investigate, and potentially prosecute, a case in which a conflict of interest exists for the usual prosecuting authority.Shawnee County District Attorney Mike Kagay says he had assigned Franklin County Attorney Brandon Jones to fill that role.Kagay says prosecutors in his office who would handle the case had appeared before Miller during his time as judge for Topeka Municipal Court. Kagay says his office also routinely requests legislative changes which involve dealing with him.Topeka police arrested Miller in May after finding him inside his crashed vehicle in the ditch. Police said he wasn't injured but appeared intoxicated.
