HUTCHINSON, Kan.&nbsp;—&nbsp;Roger McEowen, the Professor of Agricultural Law and Taxation at Washburn University School of Law is clear that foreign land ownership laws will likely be an issue for courts across the country in 2024.

"There has been a court that has weighed in on one of the state statutes on this," McEowen said. "There have been a number of states that have enacted foreign ownership restrictions in the past year, year and a half, but particularly in 2023, that was Florida. The court said it's perfectly within the state's rights to have a law that restricts foreign ownership of certain adversaries, these foreign adversaries that are on the foreign adversary list. The court didn't have any problem with that, and I think that's probably the right decision. It's a legitimate interest of the state in protecting its people and protecting the food supply."

According to the<a href="https://www.fsa.usda.gov/Assets/USDA-FSA-Public/usdafiles/EPAS/PDF/2021_afida_annual_report_through_12_31_2021.pdf"> latest USDA Agricultural Foreign Investment Disclosure Act report</a>, foreign persons held an interest in approximately 40 million acres of U.S. agricultural land as of December 31, 2021. This is 3.1 percent of all privately held agricultural land and 1.8 percent of all land in the United States.

"This will continue to be a big issue in 2024," McEowen said. "We'll have more states that enact legislation. Also in 2023, we had the state of Arkansas that pushed it even further and mandated the divestiture of agricultural land interests owned by a company controlled by the Chinese."

Crafting legislation that keeps out bad actors, while allowing for competition to continue when ag land comes up for sale will be tough in statehouses across the country.

"There are a bunch of issues that are tangled into this all over the place," McEowen said. "It's going to make it difficult for state legislatures to craft restrictions in a manner that is carefully tuned to rat out, so to speak, the problem that they are after and not paint with too broad a brush, where you get into constitutional problems," McEowen said. "It presents a thorny issue for state legislatures, for state AGs, for governors, but it's a major issue in terms of agriculture's concern."

Foreign ownership concerns go all the way back to English common law. The common law rule existed in England until it was abolished by statute in 1870.

Battle over foreign land ownership likely to continue

The USD 475 Board of Education will elect a president and vice president for the coming year when they meet Monday night at the Devin Center. The meeting begins at 6 p.m.

The Board will also set meeting dates and times for 2024.

During the meeting, Superintendent of Schools Dr. Reginald Eggleston will share with the Board his focus areas for 2024. Six-year facility plan and strategic plan are two topics listed on the agenda for that report.

Manhattan jumped out to a quick lead over the Junction City girls and never looked back. The Lady Indians defeated the Lady Jays 46-9.&nbsp;

Manhattan was led in scoring by senior Maxine Doering, who finished with 13 points. As for Junction City, Sara Rexrode scored seven of the nine points for the Lady Jays.&nbsp;

With the large margin of victory, this is the sixth time this year that Manhattan has won a game by at least 25 points. As for Junction City, nine points is the least amount of points the Lady Jays have scored this season.&nbsp;

Manhattan improves to 7-1 on the year, while Junction City falls to 0-8.

A back-and-forth game all the way to the end is how this rivalry game went. Manhattan defeated the Blue Jays 65-64 inside Manhattan High School on Friday night. The loss for Junction City was their first loss of the season.

The Manhattan Indians were led in scoring by senior Jason Kim, who had 24 points. Kim knocked down clutch free throws late to help extend the Manhattan lead to two possessions. For Junction City, the Blue Jays were led in scoring by junior Jackson Austin who finished the game with 17 points. Austin knocked down some clutch three pointers, including one with minimal time left to cut the final deficit to one.&nbsp;

With the win, Manhattan improves to 6-2 on the year, while Junction City suffers their first loss and falls to 7-1.&nbsp;

Junction City will travel to Topeka Hayden on Tuesday, January 9. 

Manhattan will play Washburn Rural next Friday, January 12.

The Junction City, Manhattan and Wamego Chambers of Commerce have released the 2nd&nbsp;Annual 15 under 40 class of young professionals making a difference in their communities.

Winners of 2024’s 15 under 40 will be recognized at a special reception in their honor at 4:30 p.m., Jan. 18 at Prairiewood Retreats, Blue Sage Barn.&nbsp;If you would like to attend the reception honoring the 2024 top young professionals, go here. If you sign up for the Regional Leader’s Retreat to be held January 19, you will receive a drink ticket to use at the reception.

“As our second year participating in this program, we are excited to see the young professionals from Junction City/Geary County recognized for their achievements.” said Jordan McCann, Member Relations Director. “Last year we had our City Clerk and local business owner, Tammy Melton win and this year, Michaela Joyce, Executive Director of Junction City Main Street. Whom has not only had a huge impact on Main Street but our community as a whole”

Winners were nominated from the three counties that make up the Manhattan MSA (Riley, Pottawatomie and Geary). Nominees were then asked to complete an application that outlined their achievements in their profession as well as work in the community. From the nearly 75 nominees and over 50 applicants, an appointed committee selected the final 15.

Geary County Commissioners will conduct their annual reorganization a short time after noon on Monday. That includes election of a chairman for the coming year plus appointment of commissioners to various boards and committees.

There will be discussion on the Taylor Road interchange about 10:30 a.m. and discussion and possible vote on a resolution for EMS Services at approximately 11:30 a.m. The County and Junction City have been in disagreement over the amount that County should pay for their share of the cost of the service.&nbsp;

the county commission is scheduled to meet from 10:30 a.m. through much of the noon hour Monday.

RILEY COUNTY —Two people were injured in an accident just after 6p.m. Thursday in Riley County.

According to the Riley Police Department activity report, a 2009 Toyota Rav 4 driven by Jeanie Peters, 74, Olsburg, Kansas was involved in a crash with a 2020 Kia Forte driven by Mia Efaw, 74, Manhattan in the 5300 block of Tuttle Creek Blvd.

EMS transported both Peters and Efaw to Via Christi for treatment of minor injuries.   Peters was issued a citation for improper driving on a laned roadway.

The Junction City area weather can be summed up in two words, hot and dry. It wasn’t necessarily THE hottest or THE driest on record, but Chuck Otte, County Extension Agent, Retired,&nbsp; said that pretty much summed up the year!

The average daily high for the year was 68.6, 2.8 degrees above average. The average overnight low was 48.1, 4.1 degree above normal. Throughout the entire year, even the one month when high temperatures were below average (March), the overnight lows were consistently above average. More greenhouse gasses in the atmosphere trap the heat in at night so the planet can’t cool as effectively. March was the only month when the average temperature was below normal and then by just one tenth of a degree. 

The daily mean temperature for 2023 was 58.3, 3.4 degrees above average. While 3.4 degrees may not sound like much, the 58.3 reading made 2023 the fifth hottest year on record for the area. The coldest temperature recorded in 2023 was the morning low of 5 degrees on January 31st. The hottest temperature for the year was the 112 reading on August 19th. That started a streak of 7 days with temperatures over 100 degrees. 

In addition to the year being the 5th hottest, we had two other months that went into the top 5. September and December were both the 4th hottest months on record. As often happens with hot weather, we had below normal precipitation. Much of the region was under some level of drought alert for nearly the entire year. Average annual precipitation is 33.57 inches. The official rain gauge at Milford Lake Corps of Engineers office could only muster 27.11 inches for the year. 

While not the driest year on record, that’s held by 1966 with only 15.61 inches, it was dry enough to make it the 23rd driest on record. January and December did manage to bookend the other ten months, and both went down with over double the average rainfall for those months. January was the 6th wettest January on record and December was the 7th wettest. The ten months in between came in over nine inches below average which took a toll on crops, pastures, lawns and gardens. It should be noted that while reliable temperature records only go back to the late 1940's, we do have reliable precipitation records dating back to 1931, or over 90 years worth.

Snowfall is normally not a significant source of precipitation for our area. Long term average annual snowfall is 18 inches which would normally only produce one and a half to two inches of liquid precipitation. The snowfall season crosses calendar years, starting in October and ending in May. The snowfall season that ended in May 2023 was rather abysmal, totaling only 4.9 inches. This snowfall season is off to a much better start, already totaling 8.9 inches, or half of what we would typically expect. Looking at the calendar year of 2023, we were still below average with 11.0 inches of snow recorded.

2023 Junction City Area Weather Review

A blood donor card or driver’s license or two other forms of identification are required at check-in. His major assignments included: Commanding General, 1st Infantry Division: July 1988-1989; Chief of Staff, U.S. Army: 1991-1995; President, Society of the First Division: 1996-2003.

General Sullivan lived a life of service to his Country, and the 1st Infantry Division.

Former 1st Infantry Division commanding general passes away

MANHATTAN — Jesse Perez Mendez, dean of the Texas Tech University College of Education, has been named the new&nbsp;<a href="https://www.k-state.edu/provost/" target="_blank">provost and executive vice president of Kansas State University</a>.&nbsp;

His appointment follows a nationwide search, with an anticipated start date on or before June 1.&nbsp;

"I am pleased to welcome Dr. Mendez to the K-State community as our next provost," said Richard Linton, Kansas State University president. "Jesse’s deep commitment to educational access perfectly aligns with K-State’s vision as a next-generation land-grant university, and the wealth of higher education experience he brings will undoubtedly serve the institution well in achieving new heights in academic excellence and innovation."

As provost, Mendez will serve as the university’s chief academic officer providing leadership for the university’s academic endeavors and for shaping the academic culture of K-State. He is also responsible for supervising K-State's strategic enrollment and student retention efforts and identifying and implementing strategies to reach the university’s next-generation land-grant goals."

Mendez’s additional professional experience includes serving as associate dean for academic affairs in the College of Education and Community Innovation for the University of Central Florida, head of the School of Educational Studies at Oklahoma State University and a governor-appointed regent for the Northern Oklahoma College Board of Regents.

Mendez earned his bachelor’s degree in political science and history from Midwestern State University and a master’s in political science from Texas Tech University. He earned a juris doctorate from the Maurer School of Law and a doctorate in higher education and student affairs, both from Indiana University.

In 2015, Mendez was named an American Council on Education Fellow and served a term as a member-at-large of the American Association of Colleges for Teacher Education Board of Directors. At Oklahoma State University, he received the OSU College of Education Leadership &amp; Service Excellence Award and held the John A. and Donnie Brock Professorship in Educational Leadership and Policy.

Junction City Fire Chief Jason Lankas announced that James Reynolds, a Captain with the Junction City Fire Department, has retired. 

Reynolds retired on December 26, 2023. He served the Junction City community as a firefighter/EMT since 1995.

The public is invited to Reynolds retirement ceremony, as he will be honored for nearly 30 years of service. The celebration will be Friday January 19, at the C.L. Hoover Opera House from 1:00-3:00 p.m.

RILEY COUNTY—Law enforcement authorities are investigating a suspect for alleged threat.&nbsp;

Just after 4p.m. Tuesday, officers filed a report for criminal threat in the 400 block of Tuttle Creek Blvd. in Manhattan, according to the Riley County Police Department activity report. 

A 17-year-old boy reported an unknown male suspect made threats to him. Seth Sumners, 46, of Manhattan was arrested for criminal threat. Sumners was issued a total bond amount of $8,ooo and is being held in the Riley County Jail.

Junction City Commissioner Richard Pinaire wants an annexation policy for the City. He is urging staff to develop a policy on what the City will do if they annex people's property.

Pinaire this week pointed to a 2006 time frame when 46 properties in the Spring Valley Road area were annexed and apparently many have still not received city water and sewer service. Yet they pay city taxes. Pinaire also wants to see them hooked up to those services for free. "I think that is immoral for the city to continue to have these people pay taxes from 25-30% of their tax rate and we not provide them with services."

Mayor Pat Landes noted that he did not know many properties that the City has come through that haven't had water and wastewater to their site. Many have been done and received those services. He pointed to replacement of a sewer line on South Spring Valley Road to serve residents in that area.&nbsp; &nbsp;"That should have been done back when they were annexed back in the 2000's. I agree. Those things I think we need to do." The mayor added, "If you've got a septic system that's still working and if we can buy a little time as we continue to recover from our financial difficulties from 20 years ago we need to do that."

Landes observed that if you're in the city you get more than water and wastewater. You also get police and fire protection services, EMS, streets, stoplights and signs. He pointed to what he termed swiss cheese holes in town and noted those haven't been contributing to everything else residents have, so it's also a matter of fairness. "We're not just here being the evil overlords, trying to take everybody's land. We're trying to give a fair shake to everybody, even the city residents.

The mayor said he plans to look into water and wastewater with the public works department to see what sites still need to be served that are within Junction City borders, and develop a plan going forward to take care of those matters.

City Manager Allen Dinkel noted that some sewer services were provided, but on the water side if customers are taken away from Rural Water District One that District may have to cease. That could cause a problem involving whether the City would need to service those in the rural area on Water District One. Discussions would be necessary there.

The baby boy weighs 5 pounds and 2 ounces, and measures 18 inches long. His parents, Domenic and Jennifer Jones, named him Aleister Athame Campbell.

Three members of the Junction City Commission took their oaths of office Tuesday night, They included Richard Pinaire, Pat Landes and Al Gordon.

Commissioners held their bi-weekly legislative meeting Tuesday evening and conducted their annual reorganization.

The Geary County Commission conducts their reorganization next Monday, Jan. 8th.

After a very chilly December 2022, December 2023 came through with above average temperatures, and for a pleasant change, above average precipitation!The average daily high for December was 47.0, 4.5 degrees above normal. Thea average overnight low was 32.4, 9.5 degrees above normal. This gave us a monthly mean temperaature of 39.7, 7.0 degrees above normal. This made December 2023 the fourth warmest December on record. 

The warmest December was the very recent December 2021 with a monthly mean temperature of 42.6. The coldest December on record was the brutal December of 1983 when we had a monthly mean temperature of only 13.6 degrees! The warmest temperature in December was 64 degrees on the 7th. The coldest temperature for the month was the morning low of 22 on the 10th. There were three temperature records set during December, all record high low temperatures. The low of 45 on the 8th broke the old record of 34 set in 1952. The low of 52 on the 21st and 22nd broke the old records of 39 set in 2020 and 49 set in 2015, respectively. &nbsp;

After a year of mainly below normal precipitation it was a pleasant change to have a month with over 200% of average precipitation. Long term average precipitation for December is 1.17 inches. Milford Lake recorded 2.84 inches for December. Several precipitation events moved through the area over the month which allowed for the precipitation to be soaked up by a thirsty soil profile. 

We ended the year well below normal however. Long term annual precipitation is 33.57 inches and we received 27.11 inches during 2023. Hopefully the wetter weather pattern will continue into 2024.Snowfall was recorded during December arriving just in time to give us an unexpected White Christmas. Long term average December snowfall is 3.7 inches and we managed 2.7 inches for the month. Thanks to the heavy late November snowfall we are still ahead of normal for the snow season. Normal through the end of December is 4.7 inches and we are currently at 8.9 inches for the season.

January is our coldest month of the year. Historically the coldest day of the year is January 4th (based on 75 years of Junction City area weather records). Even though the shortest day of the year is December 21st, it continues to get colder for a couple more weeks. Average daily highs for January begin the month at 38 and by the end of the month we have clawed our way up to 42. Overnight low on New Year’s morning is 18 and by the end of the month it has only risen to 20. The real warm up doesn’t occur until March! In additional to being our coldest month of the year, December is also our driest month of the year with only 0.73 inches of liquid precipitation. January is tied with February for our snowiest month of the year with an average of 4.7 inches.-30-

This made December 2023 the fourth warmest December on record. The warmest December was the very recent December 2021 with a monthly mean temperature of 42.6. The coldest December on record was the brutal December of 1983 when we had a monthly mean temperature of only 13.6 degrees! The warmest temperature in December was 64 degrees on the 7th. The coldest temperature for the month was the morning low of 22 on the 10th. There were three temperature records set during December, all record high low temperatures. The low of 45 on the 8th broke the old record of 34 set in 1952. The low of 52 on the 21st and 22nd broke the old records of 39 set in 2020 and 49 set in 2015, respectively. &nbsp;After a year of mainly below normal precipitation it was a pleasant change to have a month with over 200% of average precipitation. Long term average precipitation for December is 1.17 inches. Milford Lake recorded 2.84 inches for December. Several precipitation events moved through the area over the month which allowed for the precipitation to be soaked up by a thirsty soil profile. We ended the year well below normal however. Long term annual precipitation is 33.57 inches and we received 27.11 inches during 2023. Hopefully the wetter weather pattern will continue into 2024.Snowfall was recorded during December arriving just in time to give us an unexpected White Christmas. Long term average December snowfall is 3.7 inches and we managed 2.7 inches for the month. Thanks to the heavy late November snowfall we are still ahead of normal for the snow season. Normal through the end of December is 4.7 inches and we are currently at 8.9 inches for the season.January is our coldest month of the year. Historically the coldest day of the year is January 4th (based on 75 years of Junction City area weather records). Even though the shortest day of the year is December 21st, it continues to get colder for a couple more weeks. Average daily highs for January begin the month at 38 and by the end of the month we have clawed our way up to 42. Overnight low on New Year’s morning is 18 and by the end of the month it has only risen to 20. The real warm up doesn’t occur until March! In additional to being our coldest month of the year, December is also our driest month of the year with only 0.73 inches of liquid precipitation.
