TOPEKA, Kansas – Kansas Department of Corrections (KDOC) Secretary Jeff
Zmuda announced Friday that one staff member at Hutchinson Correctional Facility
(HCF) tested positive for COVID-19.

This is the seventh KDOC facility with a
confirmed case, with the first cases reported at Lansing Correctional Facility (LCF),
Wichita Work Release Facility, Topeka Correctional Facility, Kansas Juvenile
Correctional Complex, El Dorado Correctional Facility and Ellsworth Correctional
Facility, according to a media release from the KDOC.

The staff member at HCF is a male over the age of 20. In order to protect the identity
of the person, no other information will be released. Mandatory mask protocol for
staff was implemented at HCF on July 3 and on July 6 for residents.


The KDOC has been in consultation with officials from the Kansas Department of
Health and Environment (KDHE) on next steps to address these circumstances. As a
result of that consultation with KDHE, the following steps were implemented:

“We know that our battle with this virus is far from over as positive cases in our state
are continuing to rise,” Zmuda said. “We know far more about COVID-19 today

Seventh Kan. correctional facility reports case of coronavirus

TOPEKA, Kan. (AP) — Four in 10 Kansans live in counties that have overruled Gov. Laura Kelly’s statewide mask order even as coronavirus cases in the state soar.

More than 90 of the state’s 105 counties have opted out of the mandate issued last week under a new state law that allows local leaders to follow or discard Kelly’s pandemic-related executive orders.

“I’m not surprised. I think most of the local health officers aren’t, either, at this point. The mask issue has become political,” said Dennis Kriesel, director of the Kansas Association of Local Health Departments.

Six of the 10 counties with the most cases have decided against mandatory mask wearing. Nine of the 10 counties with the lowest rates of testing have also opted out, according to an analysis of public health data.

Additionally, Ford, Seward and Finney counties, where the state’s meatpacking industry is concentrated, aren’t requiring masks even though about 5% of residents in each county have tested positive — by far the highest percentages in the state.

Many county officials have touted the importance of masks while choosing not to mandate them. Among them is Reno County Commissioner Ron Hirst, who readily acknowledges masks are a way to help slow the spread of the virus.

“But I don’t think that we can put a burden on our sheriff and our health department to try to even think about enforcing this,” he said at a July 2 meeting in which commissioners voted unanimously to repeal the mandate. “Therefore in my opinion, it’s up to the public to look out after their neighbors. And they should pay attention to this.”

Of the 10 counties with the most coronavirus cases, only Wyandotte, Johnson and Douglas counties let Kelly’s order stand. Another top 10 county, Shawnee, adopted its own mask order.

The others -- Ford, Sedgwick, Finney, Leavenworth, Seward and Lyon -- all opted out of the mandate. The six counties have collectively recorded more than 8,000 cases, representing 47% of the state’s total as of Monday.

The situation is complicated, though, in Sedgwick County, where health officer Garold Minns ordered a mask mandate on his own authority, effective Friday. County commissioners can overturn his decision, but some who voted against mandatory masks last week say conditions have changed and they’ll support Minns’ order if it comes back before them.

Meanwhile, the county seat of Wichita, which is the state’s largest city, passed its own mask order, so Minns’ directive would primarily affect Sedgwick’s outlying areas.

Other cities also have taken action, including Manhattan, home to Kansas State University, along with Winfield and Parsons.

Lee Norman, the state health officer, tweeted Tuesday that Kansas was “a shining example of success, only to squander it.” Kelly was the first governor in the country to close school buildings for the rest of the school year, and restrictions on gatherings and non-essential businesses cut the rate of spread.

But that advantage has largely evaporated. The Department of Health and Environment reported 17,618 cases as of Wednesday, an increase of 717 since Monday. The agency also reported 282 deaths, up two since Monday.

4 in 10 Kansans don't have to wear masks despite mandate

COWLEY COUNTY— Law enforcement authorities are investigating an attempted kidnapping and after asking the public for help in locating a suspect have made an arrest following a Wednesday standoff with police in Nebraska.

Just after 4:30 Monday afternoon, police responded to a report of a disturbance in a vehicle
northbound from the intersection of 15th Street and Radio Lane in Arkansas City, Kansas.

A citizen told police a woman was injured and out of a vehicle in the area south of 252nd Road and 51st Road, according to police spokesperson Andrew Lawson.

An officer arrived and learned a 27-year-old Arkansas City woman had been involved in the
disturbance, after which a suspect identified as&nbsp; Leongrys Castellanos-Mesa, 35, of Grand Island, Nebraska &nbsp;had fled in the woman’s vehicle. 

The female victim was
transported by the Arkansas City Fire-EMS Department to South Central Kansas Medical Center.


Investigators later learned Castellanos-Mesa had entered the woman’s van unlawfully and hid until he reportedly attacked her.


Cowley County District Court issued an arrest warrant Tuesday for Castellanos-Mesa on suspicion
of aggravated battery, aggravated burglary of a motor vehicle, aggravated kidnapping, aggravated
robbery, battery-domestic violence, criminal threat, stalking and theft.


The initial incident took place within the city limits of Arkansas City and then moved north, out of the
city limits, where the woman was able to attempt to flee her attacker. She suffered injuries in the attempt,
but was successful in reaching safety. Castellanos-Mesa then allegedly fled the scene in her vehicle.

Officers were able to identify the suspect quickly and placed notifications to other law enforcement
agencies to be on the lookout for the suspect and the victim’s vehicle, a silver Toyota Sienna minivan.


Shortly after midnight Wednesday, Grand Island police located a vehicle known to be owned by
Castellanos-Mesa, parked in front of his residence.


They applied for a search warrant, which was executed at 1:26 a.m. Wednesday.&nbsp; The Grand Island Police Department’s Tactical Response Team (TRT) assisted at the scene after
Castellanos-Mesa allegedly barricaded himself in his basement.


Just before 5:30a.m. police took him into custody without further incident.

Castellanos-Mesa was transported to and booked into the Hall County (Neb.) Jail in lieu of $250,000
through Cowley County District Court in Arkansas City. He remained in custody at the time of this report.

EMS transported Ruelas and a passenger in the Honda 9-year-old Bentley Chase&nbsp;Inguanza of Shallow Water to the Scott County Hospital.

Kansas man dead, 9-year-old hospitalized after head-on crash

KANSAS CITY (AP) — Four former guards at a Kansas City jail have been sentenced to prison terms ranging from two years to nearly four years for beating a handcuffed inmate as a punishment.

The U.S. attorney's office said in a news release that 30-year-old Travis Hewitt and 34-year-old Jen-I Pulos were sentenced Thursday. Terrance Dooley, 39, and Dakota Pearce, 27, were sentenced last month.

Prosecutors said the victim was detained on the Fourth of July in 2015 on a probation violation in a driving while intoxicated case. He was placed in the medical housing unit of the Jackson County Detention Center because he was experiencing severe symptoms of alcohol withdrawal.

The victim subsequently got into a scuffle with a corrections officer when he attempted to go somewhere he wasn't supposed to while “clearly disoriented and unaware of his whereabouts," the release said. When the officer called for help, Hewitt and Pearce, who served as acting sergeants, responded and placed the victim in a holding cell.

Prosecutors said those two and Dooley and Pulos, who served on a team that is responsible for intervening in inmate altercations, were upset that a supervisor decided the victim wouldn't be placed in a “restraint chair” as a punishment because he was so disoriented. Several hours later, Dooley and Pulos entered the victim's cell, purportedly to remove a comb that had been fashioned into a “shank.” They then moved him to a holding cell that was out of the range of surveillance cameras, where the four assaulted him as a punishment, with one of the officers standing outside at times as a lookout, the release said.

Doctors found that the inmate had broken ribs, a punctured lung, and bruises on his face. He settled a lawsuit for $437,500 in a case that drew attention to problems at the jail and included an FBI investigation.

Federal jurors found Hewitt and Dooley guilty in October of participating in a conspiracy to deprive the victim of his civil rights and one count of deprivation of rights. The week before the trial, Pearce pleaded guilty to his role in the conspiracy, and Pulos pleaded guilty to the deprivation of rights.

“The sentences handed down in this case show that law enforcement officers who break the law, violate their oaths, and deprive inmates of their civil rights will be held accountable for their actions” said Assistant Attorney General Eric Dreiband of the Civil Rights Division in the news release.

4 ex-guards at a Kansas City jail sentenced in beating of cuffed inmate

OLATHE, Kan. (AP) — Authorities charged a 42-year-old Missouri man Thursday in the death of a woman whose body was found by police responding to a burglary call in Olathe.

The Johnson County District Attorney’s Office said in a Twitter post that Clyde J. Barnes Jr., of Kansas City, Missouri, has been charged with premeditated first-degree murder, aggravated burglary, unlawful tampering with electronic monitoring, criminal threat and violation of a protection order.

The burglary was reported around 3. a.m. Sunday, police said in a news release. The victim was identified as 42-year-old Jessica L. Smith.

Police say the killer apparently fled before officers arrived.

Man charged in death of Kansas woman during home burglary

KANSAS CITY (AP) — The federal government is stepping up to stop violent crime in Kansas City with a program named after a 4-year-old boy who was killed when someone shot into his home.

White House press secretary Kayleigh McEnany said Wednesday that the new program, “Operation Legend,” which is named after 4-year-old LeGend Taliferro, is aimed at reducing the violence that is plaguing the city.

Kansas City was reporting&nbsp;<a href="https://www.kcpd.org/media/2941/7820-daily-homicide-analysis.pdf">99</a>&nbsp;homicides as of Wednesday. With nearly half a year left, that puts the city on track to far exceed last year's total of 150.

Attorney General William Barr has directed agents from the FBI, U.S. Marshal Service, Drug Enforcement Administration and the Bureau of Alcohol, Tobacco, Firearms and Explosives to help local law enforcement. McEnany said they will be on the ground in the next 10 days.

In a news release, Barr described the death of LeGend, who was fatally shot in his bed last month, as “a horrifying reminder that violent crime left unchecked is a threat to us all and cannot be allowed to continue.”

McEnany noted that Tallifero survived a heart surgery as an infant before he “tragically lost his life.”

“We at the federal government want to make sure that never happens and use our resources to the fullest extent of the law to ensure individuals and young children like LeGend are able to live their lives and live so peacefully," she said.

Taliferro is not the first child shot this year while sleeping in his bedroom in Kansas City. In February, an 11-year-old girl was critically injured by gunfire and police found her covered in blood in the bedroom of her south Kansas City home.

Federal government to combat violent crime in Kansas City

A Ft. Leavenworth soldier who ran over an active shooter on the Centennial Bridge in late May has been honored by the Missouri General Assembly.

U.S. Army Master Sgt. David Royer was honored with a Senate Resolution sponsored by Sen. Tony Luetkemeyer of Parkville and passed by the legislature.

On May 27th, Royer was driving to his Platte City residence after working at Ft. Leavenworth, across the Missouri River, in Kansas. Royer saw traffic at a standstill on the Centennial Bridge and observed an armed driver get out of a vehicle in front of him and start shooting. Royer ran the shooter over with his car, pinning him underneath.

Royer, who is a corrections officer with the 705th Military Police Battalion, secured the scene until police could arrive.

Leavenworth soldier who ran over an active shooter on the Centennial Bridge in late May has been honored by the Missouri General Assembly.U.S. Army Master Sgt. David Royer was honored with a Senate Resolution sponsored by Sen. Tony Luetkemeyer of Parkville and passed by the legislature.On May 27th, Royer was driving to his Platte City residence after working at Ft. Leavenworth, across the Missouri River, in Kansas. Royer saw traffic at a standstill on the Centennial Bridge and observed an armed driver get out of a vehicle in front of him and start shooting. Just before 3:30 p.m. Wednesday, police responded to a bomb threat call involving a robbery at a business in the 1500 block of South Oliver in Wichita, according to officer Charley Davidson.

Officers were already nearby the business, saw the 13-year-old run from the business followed by a customer.&nbsp; 

Police arrested the 13-year-old after a short foot pursuit/

The investigation revealed, the boy entered the business and handed a note to an employee demanding money and that he had an explosive.&nbsp; 

The employee called 911, and the juvenile ran from the business after seeing police arriving.&nbsp; 

As the boy fled from the store, he struck a customer as he pushed open the door to leave.&nbsp; There was no loss from the business, and no one was injured.

The boy was booked into the Juvenile Detention Facility on requested charges of aggravated robbery and battery.

Kansas City's Sprint Center turns pink, gets new name

SEDGWICK COUNTY —Law enforcement authorities say a man critically injured in a Monday shooting in Wichita has died.

On Wednesday, Broderick Lloyd, 20, Wichita died from his injuries, according to officer Charley Davidson.

A 21-year-old man was also hospitalized with non-life threatening injuries.

Just after 12:30 a.m. on Monday, officers responded to a shooting in the area of Kellogg and Grove. Upon arrival, officers located Lloyd, who had several gunshot wounds, in a wrecked vehicle below the Kellogg and Grove Street Bridge.&nbsp; EMS transported him to a Wichita hospital for treatment.

A 21-year-old man wounded in the shooting was transported by private vehicle to an area hospital&nbsp;

The initial investigation revealed an unknown suspect shot at the victims, who were in a vehicle traveling east on East Kellogg.&nbsp; The vehicle then left the roadway and crashed underneath the bridge.&nbsp;

Upon arrival, officers located a 20-year-old victim who had several gunshot wounds to his body. Also, a 21-year-old male arrived to an area hospital via a private vehicle with multiple gunshots wounds to his body.

The initial investigation revealed an unknown suspect shot at the victim’s vehicle while on the eastbound lanes of Kellogg. 

Investigators are still trying to determine what led up to the shooting and are asking for the public’s help.&nbsp;

Police: Kansas man wounded in drive-by shooting has died

HUTCHINSON, Kan. — After insisting at its last meeting that the Kansas State Fair would go on as scheduled, the Kansas State Fair Board will meet on Monday to reconsider holding this year's event.

GM Robin Jennison said Thursday morning that factors outside of their control are pushing the decision to potentially cancel the event for the first time in 107 years.&nbsp;

On June 30, Kansas Department of Health and Environment Secretary Dr. Lee Norman advised the State Fair Board that they should cancel this year's fair.

"If I were only talking about it from a public health perspective, it would be best to not have the State Fair," Norman said. "There's no question, it will engender illness." Norman doesn't think fairgoers will wear masks.

BROWN COUNTY— Authorities with Union Pacific are investigating the cause of a Wednesday train derailment in Kansas.

Just after 3p.m. approximately 12 northbound Union Pacific train cars derailed near 320 Road east of Reserve Kansas, according to Brown County Sheriff John Merchant.&nbsp; 

&nbsp;Approximately half of the train cars were carrying petroleum products and the others were grain haulers.&nbsp; There were no spills or injuries reported, according to Merchant.

Officials closed 320th Road due to the derailment as crews continue work to clear the area.

A spokesperson for Union Pacific released no additional details Thursday morning.

WASHINGTON (AP) — The Supreme Court issued a mixed verdict Thursday on demands for President Donald Trump’s financial records that will keep his tax returns, banking and other documents out of the public eye for the time being.

By 7-2 votes, the justices upheld the Manhattan district attorney’s demand for&nbsp;<a href="https://apnews.com/f1c1c2944172b97d09b8b62345fa4031">Trump’s tax returns</a>, but kept a hold on Trump’s financial records that Congress has been seeking for more than a year.

But Trump, who has strenuously sought to keep his financial records private, didn’t immediately regard the outcome as a victory.

“The Supreme Court sends case back to Lower Court, arguments to continue. This is all a political prosecution,” Trump wrote in a series of angry tweets that followed the court rulings.

The justices rejected arguments by Trump’s lawyers and the Justice Department that the president is immune from investigation while he holds office or that a prosecutor must show a greater need than normal to obtain the records. The tax returns are being sought as part of a grand-jury investigation.

Because the grand jury process is confidential, the rulings make it likely that none of Trump’s financial records will become public soon.

Trump’s two high court appointees, Justices Neil Gorsuch and Brett Kavanaugh, joined the majority in both cases along with Chief Justice John Roberts and the four liberal justices. Roberts wrote both opinions.

“Congressional subpoenas for information from the President, however, implicate special concerns regarding the separation of powers. The courts below did not take adequate account of those concerns,” Roberts wrote in the congressional case.

The ruling returns the case to lower courts, with no clear prospect for when the case might ultimately be resolved.

The tax returns case also is headed back to a lower court, but Trump’s major arguments have now been rejected.

Justice Samuel Alito, who dissented with Justice Clarence Thomas in both cases, warned that future presidents would suffer because of the decision about Trump’s taxes.

“This case is almost certain to be portrayed as a case about the current President and the current political situation, but the case has a much deeper significance,” Alito wrote. “While the decision will of course have a direct effect on President Trump, what the Court holds today will also affect all future Presidents—which is to say, it will affect the Presidency, and that is a matter of great and lasting importance to the Nation.”

Manhattan District Attorney Cyrus Vance Jr. said his investigation, on hold while the court fight played out, will now resume.

“This is a tremendous victory for our nation’s system of justice and its founding principle that no one — not even a president — is above the law. Our investigation, which was delayed for almost a year by this lawsuit, will resume, guided as always by the grand jury’s solemn obligation to follow the law and the facts, wherever they may lead,” Vance said.

The case was&nbsp;<a href="https://apnews.com/19b82f029dcb760dc7f0c644472192fb">argued by telephone</a>&nbsp;in May because of&nbsp;<a href="https://apnews.com/VirusOutbreak">the coronavirus pandemic</a>.

The fight over the congressional subpoenas has significant implications regarding a president’s power to refuse a formal request from Congress. In a separate fight at the federal appeals court in Washington, D.C., over a congressional demand for the testimony of&nbsp;<a href="https://apnews.com/27ca90a06b7a45e29d51e4ebc9d3bda1">former White House counsel Don McGahn</a>, the administration is making broad arguments that the president’s close advisers are “absolutely immune” from having to appear.

In two earlier cases over presidential power, the Supreme Court acted unanimously in requiring President Richard Nixon to turn over White House tapes to the Watergate special prosecutor and in allowing a sexual harassment lawsuit against Clinton to go forward.

In those cases, three Nixon appointees and two Clinton appointees, respectively, voted against the president who chose them for the high court. A fourth Nixon appointee, William Rehnquist, sat out the tapes case because he had worked closely as a Justice Department official with some of the Watergate conspirators whose upcoming trial spurred the subpoena for the Oval Office recordings.

LAWRENCE, Kansas —&nbsp;The state of Kansas has settled a class-action lawsuit with attorneys who represent Kansas foster children.

Advocates&nbsp;<a href="https://www.hppr.org/post/kansas-sued-over-foster-care-s-bounced-several-children-between-100-homes" target="_blank">sued the state</a>&nbsp;in November 2018, arguing Kansas was not providing enough mental health care and shuffled children between homes too frequently. The long-troubled system has been criticized for, among other things, having children&nbsp;<a href="https://www.kcur.org/news/2018-02-21/kansas-foster-care-system-overwhelmed-as-even-more-kids-flood-in" target="_blank">sleep in offices</a>&nbsp;due to a lack of available homes.

The&nbsp;<a href="https://npr.brightspotcdn.com/88/43/d8d17d4647f7be291607d74ff635/2020-07-08-fostercarelawsuitsettlement.pdf" target="_blank">settlement</a>, which was filed Wednesday but won’t take effect until a judge approves the terms and all foster children are notified, requires the state to stop making frequent moves and to track the children more carefully. Earlier this week, Gov. Laura Kelly announced the creation of a foster care report card, which will also track outcomes.

“It’s just a really good improvement for kids,” said Teresa Woody, an attorney for the nonprofit Kansas Appleseed, who was part of the group representing Kansas foster children.

The settlement also requires Kansas to make the changes regardless of available funding.

Kansas Department for Children and Families Secretary Laura Howard said in a statement that the agreement “affirms our commitment to Kansas children.”

Howard told the State Finance Council earlier in the day that “the terms could be achieved within the current caseload budget,” according to an email from DCF spokesman Mike Deines.

Advocates initially sued the DCF, the Kansas Department for Health and Environment, the Kansas Department for Aging and Disability Services and former Gov. Jeff Colyer in 2018. Gov. Laura Kelly was added to the lawsuit when she took office, but was&nbsp;<a href="https://www.kcur.org/government/2019-11-15/governor-kelly-asks-to-be-removed-from-kansas-foster-care-lawsuit" target="_blank">later removed&nbsp;</a>when a judge agreed with Kelly’s argument that she didn’t oversee the system.

Kansas foster care advocates settle lawsuit against the state

ALLEN COUNTY —Special agents of the Kansas Bureau of Investigation have moved a man shot by two sheriff's deputies at a campground in southeast Kansas&nbsp; from a hospital to jail.

Edward Bridges, 41, Chanute, was taken into custody Tuesday after he was released from the University of Kansas Medical Center.&nbsp;

Deputies booked Bridges into the Allen County Jail on Wednesday. He is being charged in neighboring Woodson County with aggravated assault, possession of a narcotic drug, criminal possession of a firearm, possession of stolen property, criminal carrying of a weapon and possession of marijuana. He is being held on a $50,000 bond, according to the Allen County Sheriff's office.

The July 2 shooting in Neosho Falls occurred as two Woodson County deputies were questioning the man about a vehicle that had been reported stolen. Neosho Falls has about 140 residents about 75 miles (121 kilometers). southeast of Topeka. Both deputies fired shots, hitting him.

The Woodson County attorney Zelda Schlotterbeck said the investigation into the shooting is ongoing.

WOODSON COUNTY&nbsp;–&nbsp;The Kansas Bureau of Investigation (KBI) is investigating after an officer involved shooting occurred Thursday afternoon in Neosho Falls, Kansas.

The shooting occurred at approximately 3:15 p.m. Thursday near the pavilion at the campgrounds in Neosho Falls. Two deputies from the Woodson County Sheriff’s Office were attempting to question subjects regarding a nearby vehicle that was reported stolen. During questioning, an altercation occurred between the deputies and an armed male subject. Both deputies fired shots that struck the man, who was later identified as 41-year-old Edward G. Bridges, of Chanute. The deputies were not injured during the incident.

EMS responded to the scene and transported Bridges to the Allen County Regional Hospital. He was then flown to the University of Kansas Medical Center. Bridges underwent surgery and is now in stable condition.

The KBI will conduct a thorough and independent investigation into this shooting. Once completed the findings will be turned over to the Woodson County Attorney for review.

WOODSON COUNTY —The Kansas Bureau of Investigation is on the scene of an officer involved shooting that occurred Thursday afternoon when the Woodson County Sheriff’s Office was at the Neosho Falls campground attempting to question a man&nbsp; while investigating a stolen vehicle, according to KBI spokesperson Melissa Underwood.

The injured suspect was flown to the hospital with gunshot wounds. No law enforcement officers were injured during the incident.&nbsp;

SEDGWICK COUNTY — Law enforcement authorities are&nbsp;investigating an incident involving fireworks that injured a 29-year-old man.

Just before 2 a.m. Wednesday, police responded to call involving someone who was burned at an apartment complex in the 500 block of West 33rd&nbsp;Street in Wichita, according to officer Kevin Wheeler.

At the scene, officers contacted the 29-year-old man who was burned from a firework mortar that was shot at him.&nbsp; EMS transported the man to a local hospital where he was treated and released with serious, but non-life-threatening injuries.

The investigation revealed that the 29-year-old was driving in the 3000 block of North Arkansas in Wichita with his windows down.&nbsp; 

He reported that a fireworks mortar was fired into the vehicle, landed on him, and exploded.&nbsp; 

He then observed two unknown individuals in their teens or early twenties running across North Arkansas to an unknown location.

The victim drove into a nearby convenience store to seek assistance.

WICHITA —Dr. Garold Minns, Local Health Officer for Sedgwick County&nbsp; signed an Emergency Public Health Order Wednesday that will require any person within Sedgwick County to cover his or her mouth and nose with a mask or other face covering. 

The order also calls for Phase 3 of the Ad Astra Plan to be adopted and incorporated into this order along with limiting mass gatherings of more than 45 individuals in one location where social distancing is not available.

This order will take effect at 12:01 a.m. Friday morning, July 10, 2020 and to be in place until at least midnight Sunday night, August 9, 2020.
