SALINE COUNTY —Law enforcement authorities are investigating a Kansas felon for alleged domestic violence and kidnapping charges after an incident Monday.

On Monday, police were sent to Salina Regional Health Center to speak with a woman who allegedly had been injured in domestic incident, according to&nbsp; Salina Police Captain Paul Forrester.

The woman told police she was in her apartment at 2130 East Crawford Street when her boyfriend, Clarence Brown, 34, of Salina, accused her of having cameras in the apartment. Brown then allegedly began physically battering her and prevented the woman from leaving the apartment and proceeded to strangle her, according to Forrester.

The woman told police that she eventually was locked in a closet, but finally was able to convince Brown to open the closet, at which time she ran outside.

Brown allegedly caught her and was restraining her when a witness stopped a vehicle nearby. The woman was able to run to the vehicle and get in, according to Forrester.

The woman had injuries consistent with her reported abuse and police arrested on&nbsp;requested charges of Aggravated domestic violence battery, Aggravated kidnapping and Domestic violence battery.

Brown spent nearly 8-years in prison for battery against City/County Corr Officer/Employee that occurred in 2005, according to the Kansas Department of Corrections.

Police: Witness arrives, helps Kan. woman during attack

LEAVENWORTH, Kan. (AP) — A Kansas man charged with capital murder in the deaths of his two sons will remain jailed without bond.

A Leavenworth County judge ordered Donald R. Jackson Jr. held without bond during his first court appearance.

Jackson, 40, is&nbsp;<a href="https://apnews.com/article/leavenworth-oklahoma-kansas-4f619ac3b5fc3d46e2030cae5fb462f0">charged</a>&nbsp;with capital murder in the deaths of 12-year-old Austin Jackson and 14-year-old Logan Jackson, whose bodies were found at their home in Leavenworth on Oct. 24.

Authorities allege Jackson then fled his two young daughters, who were with him when he was arrested in Oklahoma.

Jackson was returned to Kansas on Thursday, Leavenworth County Undersheriff Jim Sherley said.

Jackson’s next court appearance is scheduled for Nov. 16.

Murder suspect in Amber Alert returned to Kansas jail

SEDGWICK COUNTY —A Kansas woman arrested Wednesday in connection with an injury accident in June made her first court appearance Thursday.

&nbsp; Aubriana Wilburn, 20, of Wichita,&nbsp; was charged with attempted 1st degree murder and aggravated battery, according to the Sedgwick County District Attorney.&nbsp;

Just before 1p.m. on June 22, officers responded to an injury accident in the 1600 block of South Glendale in Wichita, according to Davidson. 

At the scene, officers contacted a 33-year-old male victim with serious injuries. He was transported to an area hospital for medical treatment.

An investigation revealed Wilburn was driving a 2003 Ford Focus and was backing out of a parking stall at a business at Harry and Oliver in Wichita. The victim was walking through the parking lot of the business and was almost struck by the vehicle. 

A disturbance then ensued between the victim, Wilburn and a passenger inside of the Focus.

During the disturbance, Wilburn intentionally drove the car toward the victim, striking him, and dragging him approximately 1 ½ blocks, before fleeing from the scene. 

Investigators learned of Wilburn's involvement through the investigation. She remains jailed on a $150,000 bond and is due back in court Nov. 12, according to the district attorney's office.

Kan. woman  charged with attempted-murder for dragging man with car

BARTON COUNTY —Law enforcement authorities are investigating a case of alleged animal cruelty.

Just after 5:30p.m. November 4, deputies were dispatched to a residence in Susank, Kansas for report of animal cruelty, according to Sheriff Brian Bellendir.

 Witnesses at the scene guided deputies to a Dalmatian in a kennel that had been stabbed to death. At least one Susank resident witnessed the incident and pulled the suspect off the animal, according to Bellendir.

Sheriff’s deputies were advised a neighbor identified as Christopher B. Delauder, 32, Susank was the perpetrator. Within a short time Delauder approached the deputies and admitted to killing the dog. He had no explanation as to what prompted him to do so.

Investigation at the scene indicates the dog was in its kennel at its owner’s residence when Delauder entered the kennel and stabbed it at least eight times.

 Delauder was arrested at the scene for felony cruelty to animals and criminal trespass. He was transported to the Barton County Jail where he has since posted a $2500 bond.&nbsp;

Sheriff: Rural Kan. man admits stabbing dog to death

SALINE COUNTY —Law enforcement authorities are investigating an&nbsp;alleged attempted break-in at a north Salina motel late Sunday night.

Just before midnight, officers were dispatched for the report of a robbery in progress at the Budget King Motel, 809 North Broadway. The suspect was described by the victims as a Hispanic male wearing a blue hooded sweatshirt, brown pants, and carrying a brown long gun, according to&nbsp;Salina Police Captain Paul Forrester. The victims advised the officers that the suspect had attempted to break into the office area of the motel.

Officer arrived and located a a suspect later identified as Juan Bustamante-Espinoza, 27, of Salina, wearing clothing that matched the description.

After a brief struggle, officers arrested Bustamante-Espinoza and later located a gun matching the description provided by the victims and some missing hand tools that were taken from the motel office area in the suspect's vehicle and room.

Bustamante-Espinoza is being held on requested charges of aggravated burglary, interference with law enforcement, theft, damage to property, criminal use of a weapon and battery of a law enforcement officer.

Police: Kan. man carried long gun during motel burglary

SEDGWICK COUNTY — A Kansas man convicted of aggravated sexual battery; intentional touching is charged with failure to register as required by the Sex Offender Registration and Notification Act, according to the United State's Attorney.

Jorge Aaron Valdez-Torres, 27, Wichita, is alleged to have committed the crime from May 2018 to July 2020 in Sedgwick County.&nbsp; The Kansas Department of Corrections issued a warrant for his arrest in August.

If convicted, he could face up to 10 years in federal prison and a fine up to $250,000. The U.S. Marshals Service investigated.&nbsp;

Kansas felon failed to register as a sex offender 

RILEY COUNTY—Law enforcement authorities are investigating a shooting in the 200 block of Riley Avenue in Ogden.

Just before 11:30p.m. police responded to a report of shots fired in the 200 block of Riley Ave. in Ogden, according to a media release.

 When officers and Riley County EMS personnel arrived on scene, they found two adult male victims with apparent gunshot wounds. Two additional victims arrived at area hospitals with apparent gunshot wounds. 

Officers listed 19, 23, 27, and 28-year-old males as the victims when it was reported an unknown suspect fired multiple shots, striking all four victims. 

The 19 and 23-year-old victims were in critical condition when they were transported to Stormont Vail. The 27-year-old victim was also transported to Stormont Vail for treatment of non-life threatening injuries, while the 28-year-old victim was treated for non-life threatening injuries at an area hospital.

Just after 11p.m. Saturday as officers and Riley County EMS personnel arrived on scene they found two adult male victims suffering from apparent gun shot wounds, according to the Riley County Police Department.

 Both victims were transported to Stormont Vail in Topeka for treatment of their injuries. Two additional victims are also being treated at area hospitals, according to the RCPD.&nbsp; Police have not reported an arrest or additional details.

Update: 4 hospitalized after shooting in Ogden

A nationwide push to relax drug laws took a significant step forward Tuesday as five more states legalized marijuana for adults and voters made Oregon the first state to decriminalize the possession of small amounts of street drugs such as cocaine, heroin and methamphetamine.

The drug measures were among 120 proposed state laws and constitutional amendments that were on the ballot in 32 states. They touched on an array of issues that have roiled politics in recent years — voting rights, racial inequalities, abortion, taxes and education, to name a few.

But none directly dealt with the dominant theme of 2020 — the coronavirus pandemic. That’s because the process to put measures on the ballot began, in most cases, before the virus surged to the forefront.

The Oregon drug initiative will allow people arrested with small amounts of hard drugs to avoid going to trial, and possible jail time, by paying a $100 fine and attending an addiction recovery program. The treatment centers will be funded by revenues from legalized marijuana, which was approved in Oregon several years ago.

“Today’s victory is a landmark declaration that the time has come to stop criminalizing people for drug use,” said Kassandra Frederique, executive director of the Drug Policy Alliance, which backed the measure.

The proposal was endorsed by the Oregon Democratic Party, as well as some nurses and physician associations. The Oregon Republican Party had denounced the drug decriminalization measure as radical, and some prosecutors called it reckless.

Oregon voters also approved a measure making the state the first to legalize the therapeutic use of psychedelic mushrooms.

Voters in New Jersey and Arizona approved measures legalizing marijuana for adults age 21 and older. In New Jersey, the Legislature now will have to pass another measure setting up the new marijuana marketplace. The Arizona measure also allows people convicted of certain marijuana crimes to seek expungement of their records. The passage of the measure signaled a change of attitudes, after Arizona voters narrowly defeated a legal pot proposal in 2016.

South Dakota on Tuesday became the first state where voters authorized both recreational marijuana and medical marijuana via two separate initiatives in the same election. The legalization of recreational marijuana was approved by voters in Montana, and medical marijuana won approval in Mississippi.

A decade ago, recreational marijuana was illegal in all 50 states. Voters allowed it in Colorado and Washington in 2012, sparking a movement that already included 11 states and Washington, D.C., heading into Tuesday’s elections. Supporters hope additional victories, especially in conservative states, could build pressure for Congress to legalize marijuana nationwide.

Two states considered anti-abortion amendments with different results.

Louisiana voters passed a measure asserting there is no state constitutional right to abortion — something that could come into play if the U.S. Supreme Court overturns its Roe v. Wade decision that legalized abortion nationwide.

In Colorado, by contrast, voters defeated a measure to prohibit abortions after 22 weeks unless the pregnant woman’s life is endangered. Previous Colorado ballot initiatives to limit abortion also failed in 2008, 2010 and 2014.

Several states considered measures affecting voting rights.

Virginia voters passed a constitutional amendment taking power away from members of the Democratic-led Legislature to draw voting districts for themselves and members of Congress based on census results. It instead will create a bipartisan commission of lawmakers and citizens to develop a redistricting plan that the Legislature could approve or reject, but not change.

Virginia is the sixth state in the past two general election cycles to pass measures intended to prevent gerrymandering — a process in which politicians draw voting districts to benefit themselves or their political parties.

Voters in Missouri, who passed a redistricting reform measure in 2018, decided Tuesday to roll back key parts of it before it could be used next year. They passed a measure placed on the ballot by the Republican-led Legislature to repeal a nationally unique model that would have used a nonpartisan demographer to draw state House and Senate districts to achieve “partisan fairness” and “competitiveness.” The measure instead returns those duties to bipartisan commissions and drops “partisan fairness” and “competitiveness” to the end of the priority list.

In Florida, voters approved a measure gradually increasing the minimum wage to $15 an hour by 2026. The measure puts Florida in line with at least seven other states — California, Connecticut, Illinois, Maryland, Massachusetts, New Jersey and New York — and Washington, D.C., which already have enacted laws to gradually boost the minimum wage to $15 an hour.

In Mississippi, voters approved a proposal for a new state flag with a magnolia design. The vote came after legislators in June ended the use of a flag bearing a Confederate battle emblem. In Rhode Island, whose official name is “Rhode Island and Providence Plantations,” a proposal was leading to eliminate the final three words, which some say evoke a legacy of slavery.

Tax proposals were on the ballot in more than a dozen states. Tobacco tax hikes passed in Colorado and Oregon. Colorado voters also approved a slight income tax cut. Proposals to charge higher income taxes on the wealthy were trailing in Illinois but leading in Arizona, where the new revenue would fund pay raises for teachers and other school personnel. A California property tax increase on businesses remained close.

In California, Uber, Lyft and other app-based ride-hailing and delivery services prevailed in their expensive fight to keep drivers classified as independent contractors. The ballot initiative pitted the powerhouses of the so-called gig economy, including DoorDash, Postmates and Instacart, against labor unions. It was the most expensive California ballot measure ever — more than $220 million was spent, most by the gig companies.

The measure creates an exemption to a state law that would have made drivers eligible for benefits that come with being company employees. San Francisco-based Uber and Lyft had threatened to pull out of California if they lost.

Among the many California ballot proposals was one to repeal a 1996 initiative that prohibits affirmative action programs granting preferential treatment based on race, sex, color, ethnicity or national origin in public employment, education or contracting. It was trailing in the polls.

Kan. man out of prison 4-months jailed for alleged child sex crime

KANSAS CITY (AP) — A Kansas City man has been sentenced to 26 years in prison for killing a Christian missionary from China and wounding two others while high on PCP.

The evangelical group’s headquarters is near the scene of the shooting. Investigators have said Hao was walking when he encountered Hudson, then 18, who was randomly shooting at people. Two other people were wounded before Hudson was arrested.

Hudson told police he believed Hao was an accomplice of another man he’d been arguing with moments before.

Hudson's defense attorney had argued at trial that Hudson had smoked a marijuana cigarette without knowing it had been dipped in PCP and was “in a state of psychosis" when the shooting occurred.

The investigation revealed Nolen was at the Sports Complex, and a verbal argument ensued between him and Hall on the west side of the stadium bleachers.&nbsp; During the argument, Hall pulled out a handgun and fired multiple shots, striking Nolen.&nbsp; Nolen was taken to the hospital in a private vehicle by two individuals with him at the Sports Complex, and Hall fled on foot.&nbsp; No one else was injured.

Police: 2 dead, 3 injured in Kansas City shooting

TOPEKA, Kan. (AP) — A Democratic candidate who admitted to circulating revenge porn and was charged at the age of 14 with threatening to shoot a high school student has won a state House seat in Kansas, and party leaders promised Thursday to try to oust him after what they saw as a threat against the governor.

Aaron Coleman was the only candidate on the ballot in his Kansas City, Kansas, district in Tuesday’s election, but the 20—year-old faced the veteran state lawmaker whom he defeated in the Democratic primary and a Republican candidate who ran as write-ins.

Coleman began identifying himself on Twitter&nbsp;<a href="https://twitter.com/Aaron4KS37" target="_blank">as “Rep.-elect”</a>&nbsp;and on Wednesday criticized Democratic Gov. Laura Kelly in tweets as&nbsp;<a href="https://twitter.com/Aaron4KS37/status/1324108395696345092" target="_blank">a “Republican” unfit to serve</a>&nbsp;because she doesn’t support Medicare for All or the Green New Deal plan to combat climate change and suggesting “radical progressives” will prevent her reelection in 2022. Coleman&nbsp;<a href="https://apnews.com/article/d7ea4a5bc168f3b608ea96c81efb6c78">touted a liberal platform</a>&nbsp;in defeating Democratic state Rep. Stan Frownfelter by 14 votes in the August primary.

A political operative provided The Associated Press with a screen shot of another tweet that was no longer online Thursday in which Coleman predicted that Kelly would face an “extremely bloody” Democratic primary in two years. The screen shot was provided anonymously because the operative was not authorized to speak about the race.

“I’m not playing around,” Coleman wrote in the tweet. “People will realize one day when I call a hit out on you it’s real.”

Kelly spokeswoman Lauren Fitzgerald responded to Coleman’s tweets by saying in an email: “Aaron Coleman is unfit to serve in the Legislature.”

Coleman acknowledged during an interview posting the tweet and then deleting it Wednesday, saying he’d intended to used the phrase “political hit,” adding, “Obviously I should have moved away from the word ‘hit.’”

“There are people out there who will intentionally try to misinterpret anything you say,” Coleman said. “It’s fine. I’m not worried about it. Really, at this point, nobody can really stop me.”

But Kansas House Minority Leader Tom Sawyer, a Wichita Democrat, described the tweet as “threatening the governor.”

Coleman’s social media post came less than a month after authorities said they&nbsp;<a href="https://apnews.com/article/michigan-checks-and-balances-archive-gretchen-whitmer-da09ca66cd8d5f36722021d3593425ff">foiled a plot</a>&nbsp;to kidnap Michigan Gov. Gretchen Whitmer, another Democrat, in reaction to her handling of the coronavirus pandemic. An FBI agent testified in federal court that members of&nbsp;<a href="https://apnews.com/article/virus-outbreak-kidnapping-michigan-gretchen-whitmer-arrests-b0d90b827be272781239f8e841d635dd">paramilitary groups also discussed</a>&nbsp;kidnapping Democratic Virginia Gov. Ralph Northam.

Sawyer said he or other Democrats in the House will file a complaint against Coleman when he’s sworn in and work for the two-thirds vote in the House needed to remove Coleman from his seat. The state Democratic Party already had disowned Coleman in August, and state Chairwoman Vicki Hiatt publicly backed such an effort Thursday, with both she and Sawyer calling Coleman unfit to serve.

But Coleman said he’s consulted with a lawyer and believes he only can be removed from his seat for misconduct in office, not for actions before taking office in January.

“Until I break the public’s trust and I break my oath of office, you know, you cannot undo the results of democracy,” Coleman said.

Later, he added: “I’m going keep my head down and do my homework and try not to get any more headlines for a while.”

Unofficial election results showed 3,496 votes for Coleman and 2,013 total write-in votes. The local Board of Canvassers is scheduled to meet Nov. 16 to review provisional ballots cast by voters whose eligibility wasn’t certain.

Wyandotte County Election Commissioner Bruce Newby said it’s “very rare” for all write-in votes to go to a single candidate. Newby said he doesn’t have a countywide count of provisional ballots yet, but that there would almost certainly not be enough in Coleman’s district to change the result. About 3,000 ballots mailed to voters countywide had yet to arrive, but Newby said it’s likely that only several hundred will arrive by Friday’s deadline. Even if all of them arrived on time, he said, only a fraction would be for Coleman’s district.

“Quite honestly, there’s no hope there,” Newby said of overcoming Coleman’s victory.

Coleman was charged in May 2015 with a felony count of making a criminal threat but later pleaded guilty to a misdemeanor charge of harassment. An arrest report and investigative summary from the incident, obtained by AP through an open records request, said Coleman threatened to go to a girl’s high school, shoot her, and turn the gun on himself.

State Rep-elect vows to "call out a hit" on Kansas governor

BELLE PLAINE, Kan. (AP) — A federal appeals court ordered the immediate release of a Russian mother whose case garnered international attention after she was convicted of kidnapping for moving her children from the U.S. to Russia amid a divorce.

Bogdana Alexandrovna Osipova, who is referred to by her married name of Mobley in court documents, was&nbsp;<a href="https://apnews.com/article/8f3bd4edb5284519a0e5dc33155ff402">convicted in Kansas last year&nbsp;</a>of one count of international parental kidnapping and two counts of attempting to extort money.

A three-judge panel of the U.S. 10th Circuit Court of Appeals overturned the two extortion convictions in August but upheld the conviction for parental kidnapping, sending the case back to U.S. District Judge Eric Melgren for resentencing.

Federal prosecutors did not fight the panel’s decision, telling Melgren in a filing that further review was not authorized by the Solicitor General’s Office.

Osipova, who has been imprisoned since her 2017 arrest, sought her release because she had already served the maximum three-year prison sentence allowed on the remaining count. She filed an emergency appeal after Melgren did not immediately free her.

The federal appeals panel told Melgren on Wednesday to order her release and schedule a date for resentencing via videoconferencing. It also “strongly” encouraged him to consider releasing her to the custody of her mother and stepfather in New York pending resentencing.

Her attorney, Craig Divine, did not immediately return an email message Thursday seeking comment.

Osipova, who has dual Russian and U.S. citizenship, left Wichita, Kansas, in 2014 with one child from her first marriage and another child from a second marriage to Brian Mobley, an Air Force recruiter. She gave birth to a third child soon after returning to Russia.

The Kansas judge awarded sole custody to her ex-husband because she had left the U.S. without court approval or Mobley’s knowledge. A Russian court awarded custody to Osipova.

Osipova was arrested in September 2017 after returning to the U.S. without her children to change child support arrangements.

Her case has sparked an international tug-of-war. Russia demanded last year that Osipova be released, while U.S. Rep. Ron Estes called on Russia to reunite the Kansas father with his children.

Court orders release of Russian mom convicted of taking Kan. kids

BARTON COUNTY —Law enforcement authorities are investigating a woman on numerous charges involving an unlicensed day care.

On Tuesday, November 3, police executed a search warrant at a home at 1819 Madison Street in Great Bend in reference to theft by deception, operating a daycare without a license and impersonation of an officer and medical professional, according to a media release.

During the course of this investigation, detectives learned that Carrie Carl, 43, Great Bend, claimed to have worked for the Great Bend Police Department as well as fabricated a pregnancy and death of her infant, according to the release.

Carl had a funeral for the infant and made up a false obituary and had it printed in the local newspaper. Carl had also claimed to be a licensed daycare provider even after her daycare license was terminated in July of 2020 and continued to provide daycare services.

During a thorough search of the residence, documents and electronic evidence were located and seized.

Carl was arrested for theft by deception, false impersonation, and license / temporary daycare permit required and transported to the Barton County Detention Center where she was booked and confined in lieu of bond.

This investigation is still ongoing and the Great Bend Police Department would like to locate any additional victims that were taken advantage of by donating money, goods or services to Carl.

Police: Kan. woman accused of fabricating infant's birth, death

SEDGWICK COUNTY —Law enforcement investigating an injury accident and after asking the public for help have located and arrested&nbsp; 20-year-old Aubriana Wilburn of Wichita.

At the scene, officers contacted a 33-year-old male victim with serious injures. He was transported to an area hospital for medical treatmentand remains hospitalized.

Investigators learned of Wilburn's involvement through the investigation.

&nbsp;Wilburn is being held on requested charges of attempted murder, aggravated battery, and an outstanding warrant, according to officer Davidson. She was to make a first court appearance Thursday, according to the Sedgwick County District Attorney's office.

A disturbance then ensued between the victim, Wilburn and a passenger inside of the Focus.During the disturbance, Wilburn intentionally drove the car toward the victim, striking him, and dragging him approximately 1 ½ blocks, before fleeing from the scene. Investigators learned of Wilburn's involvement through the investigation.&nbsp;Wilburn is being held on requested charges of attempted murder, aggravated battery, and an outstanding warrant, according to officer Davidson. Kan. woman faces charges for dragging man with car

SALINE COUNTY —Law enforcement investigating a series of burglaries in Salina have four suspects in custody. 

The Saline County Sheriff's office had received 14 reports of vehicles being entered and, in many cases, items being stolen, that spanned a time period from Oct. 27 to Nov. 2, according to&nbsp;Saline County Sheriff Roger Soldan.

Additionally, a vehicle was stolen from Hedville early Monday morning and was located at approximately 8 a.m. Monday when a Salina Police officer attempted to pull it over near the Rodeway Inn and Suites, 3932 South Ninth Street.

Keyshawn Edwards, 23, Saline, is being held on requested charges of burglary of a non-residential building, Four counts of burglary of a motor vehicle, six counts of theft and one count of criminal trespassing.

Hewitt is being held on requested charges of&nbsp;&nbsp;burglary of a non-residential building, Four counts of burglary of a motor vehicle, five counts of theft, one count of criminal tressspassing, one count of possession of methamphetamine and one count of possession of drug paraphernalia.

Richard Anderson, 40, of Salina, who was found hiding in a maintenance closet at the Rodeway Inn, was arrested on active warrants.

Brady Maxwell, 31, of Salina, was arrested on active warrants and a requested charge of obstruction.

SEDGWICK COUNTY — A retired firefighter who charged with threatening to kidnap and kill the mayor of Wichita because he was upset about the city’s mask ordinance is scheduled for another court appearance Thursday afternoon, according to the district attorney's office.

Meredith Dowty, 59, Wichita, was charged with three counts of criminal threat.

Wichita Mayor Brandon Whipple said he had been read text messages received by another city official that threatened his life.

The mayor says the suspect talked about tyranny in the messages and was upset about the mask mandates and not being able to see his mother because of COVID-19 restrictions on elderly homes.

In Kansas, criminal threat is a level 9 felony which means, depending on his criminal record, it’s possible Mr. Dowty could receive anywhere from probation to 17 months in prison on each count, if he’s convicted, according to the district attorney.

Dowty is no longer in custody, according to online jail records.
